July 24, 2017 Council Meeting Minutes

PRESENT
President Tompkins, Vice President Rich, Councilpersons Forgeng, Harbaugh, Hegele, McElroy & Palmer, Mayor Hawkes; Borough Manager Zollers, Assistant Secretary Hegele, Solicitor Walko, Chief Gardner, Fire Marshal Myers & Engineer Walsh.

ABSENT
Treasurer Kaljnas was absent.

CALL TO ORDER
President Tompkins called the meeting to order at 7:00 P.M.

INVOCATION
Mayor Hawkes had a moment of silence for the victims in Solebury.

PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Chief Gardner.

MEETING NOTES – President Tompkins announced that the first privilege of the floor is for voting agenda items only.

PRIVILEGE OF THE FLOOR – There was no comment from the public.

COMCAST CABLE FRANCHISE RENEWAL HEARING – President Tompkins stated the hearing was opened to provide public comment pursuant to Section 626 of the federal cable act, which sets forth the process for franchise renewal.  President Tompkins asked if there was any comment from the public regarding Comcast, their services and the franchise agreement.  There was no comment, therefore the hearing was closed.  Assistant Secretary Hegele stated by way of these minutes she would notified Comcast.

MAYOR’S REPORT – Mayor Hawkes reminded everyone that the car show is this weekend.

PRESIDENT’S REPORT – President Tompkins also reminded everyone that in addition to the Car Show, National Night Out is Friday, August 4th.

TREASURER’S REPORT – Treasurer Kalnajs as absent, Councilman Harbaugh gave the Treasurer’s Report for the month of June 2017.  He noted a balance of $4,982,976.84.  Interest earned for the month totaled $2,264.16 on all accounts.

SOLICITOR’S REPORT – Solicitor Walko stated she had no report this month.

ENGINEER’S REPORT – Engineer Walsh stated he had no report this month.

MANAGER’S REPORT – Manager Zollers provided the following updates:

  • The commuter signs on N. Penn Street have been ordered, signs will guide commuters to Station Park.
  • Playground signs have been ordered, had them before but signs deteriorated
  • Fire Marshal has ordered no smoking in mulch area of playgrounds.

CHIEF OF POLICE REPORT – Chief Gardner provided the following updates:

  • Millbrook Society is doing an event at the Hatboro Baptist Church, the Civil War Encampment will have troops camping on lawn and they will be firing blanks from Civil War era rifles.
  • He stated he recently met with Car Show committee and everyone is ready for the event. There are some changes to parking this year.
  • He provided Council with an update on hiring, he hopes Council will approve tonight a conditional offer to a candidate.

TAX COLLECTIONS REPORT
The Tax Collection Report was submitted to Council is advance of tonight’s meeting, and that copies of the report were available.

PUBLIC WORKS REPORT – The Public Works Report was submitted to Council in advance of tonight’s meeting, and that copies of the report were available on the sign in table.  Manager Zollers stated he had nothing further to report.

FIRE MARSHAL REPORT – The Fire Marshal Report was submitted to Council in advance of tonight’s meeting, and that copies of the report were available on the sign in table.  Fire Marshal Myers stated Emergency Management is ready for the car show and will also have a table out at National Night Out.  He announced the new EOC was activated earlier this month, it was a mini activation, but all went well in the new police station EOC.

VOTING ITEMS
Acknowledgement of Reports – Councilman Palmer motioned to acknowledge the receipt of the tax collections, public works, fire marshal, treasurer’s reports, Borough Authority Minutes and UMHJSA minutes, motion seconded by Vice President Rich, all ayes.  Motion carried 7-0

Approval of Warrant List, Payment of Bills, Manual Checks and Transfers – Councilman Forgeng motioned to approve the warrant list, payment of bills, manual checks and transfers for the month of July 2017, motion seconded by Councilwoman McElroy, all ayes. Motion carried 7-0.

APPROVAL OF MINUTES
June 26th, 2017 Council Meeting – Councilman Harbaugh motioned to approve the June 26th, 2017 Council meeting minutes.  Councilman Harbaugh asked to add the amount of bid received for the sale of the parcel on Warminster Road.  Assistant Secretary Hegele stated she would amend the minutes to include the $1000.00 amount.  Councilman Harbaugh also indicated he was going to abstain from the vote as he was not at the meeting, motion seconded by Councilman Hegele.  Motion carried 6-0 with one abstention.

July 10th, 2017 Committee Meeting – Councilwoman McElroy motioned to approve the July 10th, 2017 Committee meeting minutes, motion seconded by Councilman Palmer, all ayes.  Motion carried 7-0.

FIRE COMPANY EXPENDITURE LIST – Councilman Palmer motioned to approve the Enterprise Fire Company Expenditure List for June in the amount of $8,127.84 motion seconded by Councilman Hegele, all ayes.  Motion carried 7-0.

CORINTHIAN TRAIL GRANT SUBMISSION – Councilwoman McElroy motioned to approve submission of the Transportation Alternatives Grant for the Corinthian Trail Project, motion seconded by Councilman Harbaugh, all ayes.  Motion carried 7-0.

FACILITIES PROJECT – RETAINAGE RELEASE – Vice President Rich motioned to authorize partial release of retainage in the amount of 2%, motion seconded by Councilman Palmer all ayes.  Motion carried 7-0.

FACILITIES PROJECT – POLICE – PAYMENT REQUEST #12 – Councilman Hegele motioned to approve payment request number 12 in the amount of $22,390.81.  Manager Zollers stated Project Manager Zadlo has signed off on the request and the HVAC system appears to be working well, motion second by Vice President Rich, all ayes.  Motion carried 7-0.

MEMORIAL POOL COVER PROJECT – Councilman Palmer motioned to authorize advertising bids for the memorial pool cover project, motion seconded by Councilwoman McElroy, all ayes.  Motion carried 7-0.

WARMINSTER/BYBERRY UPDATED AGREEMENTS – Manager Zollers stated that he has gotten nowhere with Penndot, they have agreed to meet but have said they have no intention of changing.  He stated they refuse to meet during rush hours.  Councilman Hegele asked if we have gotten video and pictures at rush hour to share with them.  Vice President Rich motioned to authorize proceeding with meeting and signing if amended, motion seconded by Councilman Harbaugh, all ayes.  Motion carried 7-0.

Mr. Dave Stockton, Jacksonville Road stated he sent a letter to Manager Zollers, he asked if there was anything more he could do.  Manager Zollers stated he received numerous letters, they seem to fall on deaf ears with Penndot, he stated if something else is needed he will reach out to everyone who wrote in support of the project.

PUBLIC WORKS VEHICLE PURCHASE – Councilman Palmer motioned to purchase, one lift truck (cab/chassis at $65,986.00), one pickup truck at a cost of $23,593.55 and a lift gate in the amount of $2,794.00.  Councilman Harbaugh stated these prices are lower than previously discussed at Capital Budget.  He would like to see the purchase this year before the new models come out and the price increases, motion seconded by Councilman Hegele, all ayes.  Motion carried 7-0.

MS4 POLLUTION REDUCTION PLA PERMIT – Vice President Rich motioned to authorize the advertising of the MS4 Pollution Reduction Plan Permit, motion seconded by Councilman Hegele, all ayes. Motion carried 7-0.

SPECIAL UPDATES – Councilman Hegele noted he was wearing his vote for Lochel’s pin and reminded everyone there was only a few more days left to vote.  Councilwoman McElroy stated the Steering Committee is working on creating a logo and and is working on research and review of demographics and statistics There will be a public meeting in the fall for public input.

OLD BUSINESS CONDITIONAL OFFER – PATROL OFFICER – Councilman Hegele motioned to approve the conditional offer to candidate pending Civil Service review, motion seconded by Councilman Harbaugh, all ayes.  Motion carried 7-0.

NEW BUSINESS
Zoning Hearing Board – Wawa:  President Tompkins stated a date has yet to be determined for September.  He stated it will not be on September 13th as previously thought.
