PRESENT VIA ZOOM – President Bollendorf, Vice President Stockton, Councilwoman Anzinger, Councilwoman Benjamin, Councilwoman McMenamin, Councilwoman Reichner, Councilwoman Ostrander, Mayor Schultz, Chief Gardner, Manager Hegele, Assistant Secretary DeRenzis, Superintendent Frydlewicz, Deputy Superintendent Dermer, Treasurer Rich, Tax Collector/Fire Company President Mount, Librarian Celec, Solicitor Geiser, and Engineer Goff were present.

ABSENT – There was no one absent.

CALL TO ORDER – President Bollendorf called the May 17, 2021Committee to order at 7:00 P.M.

INVOCATION – Mayor Schultz led the invocation.

PLEDGE OF ALLEGIANCE – Chief Gardner led the Pledge of Allegiance.

MEETING NOTES – President Bollendorf reviewed the Public Comment Policy on the back of the agenda with regards to addressing Council and time allotment.

NEW BUSINESS
1) Public Safety Committee

  • ENTERPRISE FIRE COMPANY EXPENDITURE LIST – Councilwoman Ostrander stated that this to approve the Enterprise Fire Company Expenditure List for the month of April 2021 in the amount of $13,348.39. This item was moved to the May 17, 2021 Council Meeting Agenda for approval.

2) Finance/Grants Committee

  • FEE SCHEDULE UPDATE (HOOKAH ORDINNCE FEE) – Vice President Stockton stated that this for Resolution 2021-31 approving updates to the fee schedule for Hookah Lounge registrations ($125). This item was moved to the May 17, 2021 Council Meeting Agenda for approval.
  • FEE SCHEDULE UPDATE (POOL FEES) – Vice President Stockton stated that this is swim lessons ($100 for members and $120 for non-members), Pool Parties (Resident Members – $7.50 and resident non-members $9.00 with a cap at 25 people for a party). This item was moved to the May 17, 2021 Council meeting Agenda for approval.
  • FEE SCHEDULE UPDATE (GAZEBO RENTAL FEES) – Vice President Stockton stated that this is for Gazebo Rental/Miller Meadow Fees ($30 ½ day & $60 full day for residents and $50 ½ day and $100 full day for non-residents. If non-resident uses services from a Hatboro Business, they will be charged the resident rate IF the business books the gazebo). This item was moved to the May 17, 2021 Council Meeting Agenda for approval.
  • KEEP PENNSYLVANIA BEAUTIFUL GRANT – Vice president Stockton stated that this is to apply for the Keep Pennsylvania Beautiful Grant for Mugwort Removal in Miller Meadow in the amount of $20,550.00. This item was moved to the May 17, 2021 Council Meeting Agenda for approval.
  • WATERSHED RESTORATION AND PROTECTION GRANT – Vice President Stockton stated that this is to apply to the Watershed Restoration and Protection Program Grant for the Celano Park Riparian Buffers and Inlet Filter Project. This item was moved to the May 17, 2021 Council Meeting Agenda for approval.
  • GROWING GREENER GRANT – Vice president Stockton stated that this is to apply to the Growing Greener Grant for the Celano Park project. This item was moved to the May 17, 2021 Council Meeting Agenda for approval.
  • DCED MULTIMODAL TRANSPORTATION GRANT – Vice President Stockton stated that this is to apply to the DCED Multimodal Transportation Grant for the York Road Sidewalk expansion project to improve ADA compliance around telephone poles. This item was moved to the May 17, 2021 Council Meeting Agenda for approval.
  • UNION LIBRARY EXPENDITURE LIST – Vice President Stockton stated that this is to approve the Union Library Expenditure List for the month of May 2021 in the amount of $9,758.65. This item was moved to the May 17, 2021 Council Meeting Agenda for approval.

3) Community Outreach & Events Committee

  • FAITH IN BLUE SPECIAL EVENT REQUEST – Councilwoman Reichner stated that this is to approve the special event request for the Faith in Blue Event which is Nationwide to bring communities of Police together. This item was moved to the May 17, 2021 Council Meeting Agenda for approval.
  • YOGA IN EATON PARK EVENT REQUEST – Councilwoman Reichner stated that this is to approve the special event request for yoga classes in Eaton Park. This item was moved to the May 17, 2021 Council Meeting Agenda for approval.
  • ELECTRONIC NEWSLETTER SIGN UP ANNOUNCEMENT – Councilwoman Reichner stated that this is a monthly newsletter for residents to keep them updated in addition to the twice a year paper newsletter. If you sign up with the form that is posted on social media and web pages.
  • NEW BUSINESSES – Councilwoman Reichner stated that the following are new businesses in Hatboro:
    – Street Food Sandwich Shop – 7 S. York Road
    – Shann Smoke Shop – 5 N. York Road
  • MAY/JUNE EVENTS – Councilwoman Reichner announced the events for May and June 2021.
  • HISTORIC OVERLAY ORDINANCE UPDATE/DISCUSSION – Councilwoman Reichner stated that the draft was sent to the Montgomery County Planning Commission for the formal review and will go back to the Hatboro Planning Commission on June 8, 2021 for a final review and then back to Council for adoption at the June 21 Committee/Council Meeting.
  • ZONING SUB-COMMITTEE UPDATE – Councilwoman Reichner stated that this committee meets once a month to discuss zoning on York Road for the business district and that they met last week. She also stated they are working on the goals that were laid out in the 2040 Plan.
  • WAWA UPDATE – Councilwoman Reichner stated that the Borough received a formal Land Development application from Wawa, and it is currently being reviewed by the County Planning Commission and this will be presented to the Borough Planning Commission June 8, 2021.

4) Public Works Committee

  • 2021 ROAD PAVING PROJECT – Councilwoman Benjamin stated that the following streets need to be milled and repaved:
    • S. Chester Avenue and Williams Lane to W. Lehman Avenue 
    • S. Linden Avenue and W. Moreland to dead end
    • Franklin Avenue and S. Chester Avenue to S. Linden Avenue
    • Williams Lane and S. Chester Avenue to S. Linden Avenue
    • E. Monument Avenue and N. York Road to N. Penn Street
    • N. Penn Street and E. Montgomery to E. Monument Avenue
    • N. Penn Street and E. Monument to Summit Avenue

      Councilwoman Benjamin also stated that this will be needed over the next three years and she suggested that the Borough get cost estimates and compare to liquid fuels and prioritize based on that. Superintendent Frydlewicz stated that he was meeting with Engineer Goff tomorrow to review the streets and he will get a budget for Council and that Linden Avenue is bad and he would move that to top of the list. This item was tabled until we get estimates.

  • AQUA WATER MAIN REPLACEMENTS – Councilwoman Benjamin stated that Aqua is going to be replacing some water mains which will impact the following streets:
      • Oakdale avenue between Jacksonville and Meadowbrook
      • Meadowbrook Avenue between Oakdale Avenue and Celano Park
      • N. Penn Street between Meadowbrook Avenue and Summit Avenue
      • Horseshoe Lane and Mill Road to Lantern Lane
      • W. Lehman Avenue between bank Street to S. Chester Avenue

        Councilwoman Benjamin also stated that some streets were already repaved and asked if we were responsible and Superintendent Frydlewicz stated that they would be responsible curb to curb for the sections they will be working in.
  • POOL CLEANING/SANITIZING – Superintendent Frydlewicz stated that they had a company come out and do a test and used the locker room as a test area. He also stated that if they use their product, they will come in and instruct them on how to use the product and you can go six months without sanitizing because it will coat the area and it can be used for other areas such as the Borough buildings and the police jail cells. He also stated that after testing, the building would become a certified facility. He also stated that it will save a lot of Public Works man hours using this company. Councilwoman Benjamin stated that she is concerned with the oxidation in certain areas that may not be necessary as she works in pharmaceuticals and asked Superintendent Frydlewicz if she could see some of the test reports once they are done.


5) Environmental Affairs & Parks Committee

  • AMENDMENT TO PARKS RULES FOR GAZEBO IN MILLER MEADOW (USE & DECORATIONG REGULATIONS) – Councilwoman Anzinger stated that now that we have a gazebo, we need to regulate how it will be used and she recommends this be moved towards adoption. She also stated that if the Borough plans to use as a wedding venue, we should include food and alcohol service. This item has been moved to the May 17, 2021 Council Meeting Agenda for approval.

  • EAC UPDATE – Councilwoman Anzinger stated that they had a meting earlier and discussed different things that they would like the community to weigh in on and one thing being the Wawa submission and they are taking a look at the recycling ordinance to see if there is any additional input to be given regarding that. She also stated that a few members attended an EAC networking conference to create a network with other EAC in the area. She also stated that they talked about a light and old growth ordinance and they got a final proof of a logo.

6) Administration Committee

  • SOLICITAITON ORDINANCE UPDATE – Councilwoman McMenamin stated that this is to authorize the solicitor to draft an amendment to the solicitation ordinance. This item was moved to the May 17, 2021 Council Meeting Agenda for approval.

  • POOL EMPLOYEE RATIFICATION LIST – Councilwoman McMenamin stated that they have six additional Lifeguards, and this is to approve the updated 2021 Pool ratification List. This item was moved to the May 17, 2021 Council Meeting agenda for approval.

  • SNACKSTAND RFP – Councilwoman McMenamin stated that that the former vendor is no longer interested in running the snack stand and that it has been advertised to try to locate another vendor but no one has expressed an interest.

  • APPOINTMENT OF DEPUTY CODE OFFICIAL – Councilwoman McMenamin stated that this is to approve Resolution 2021-30, appointing Kyle Dermer to the position of Deputy Code Official. This item was moved to the May 17, 2021 Council Meeting Agenda for approval.

  • BOROUGH HALL HVAC PROJECT – FIRE SUPPRESSION CONTRACT – Councilwoman McMenamin stated that this is to award the base bid for the Borough Hall HVAC Project Fire Suppression Contract to Guy M. Cooper in the amount of $339.,000.00. This item was moved to the May 17, 2021 Council Meeting Agenda for approval.

  • BOROUGH HALL HVAC PROJECT – MECHANICAL CONTRACT – Councilwoman McMenamin stated that this is to award the base bid for the Borough Hall HVAC Mechanical Contract to Guy M. Cooper in the amount of $1,310,000.00. This item was moved to the May 17, 2021 Council Meeting agenda for approval.

  • JUNE 2021 MEETING ANNOUNCEMENTS – Councilwoman McMenamin announced the meetings for the month of June 2021.

OLD BUSINESS AND UPDATES – There was no old business or updates.

COUNCIL MEETING
MONDAY, MAY 17, 2021

CALL TO ORDER – President Bollendorf called the May 17, 2021 Council Meeting to order at 7:50 P.M.

PUBLIC COMMENT – There was no public comment.

MAYOR’S REPORT – Mayor Schultz stated that the Hungry Hideaway has been a big hit and people are excited to be out and Bernie’s has put together a program where every day there is a different activity.

Mayor Schultz also stated that last weekend there were two ribbon cuttings, Trattoria Valona and Williams Lane.
Mayor Schultz also stated that there is a Ribbon Cutting at Miller Meadow at 10 A.M on Saturday May 22, 2021 for the Gazebo dedication to John Kulick. Mayor Schultz reminded everyone to vote tomorrow.

OFFICER’S REPORTS

  • PRESIDENT’S REPORT – President Bollendorf stated that he had a meeting with the Solicitor and Borough Manager because we are at the point to start back with in person meetings and they were discussing to start this in July. He also stated that at least four Councilpersons should be present in Borough Hall and the rest can do virtual if they choose to do so and stated that they should start this in July 2021.

    President Bollendorf also stated that the Primary is tomorrow, and this is the local election and he encouraged everyone to come out and vote.

    President Bollendorf also stated that the Borough will be receiving stimulus funds and once they get an amount and find out when we will be receiving it, it will be run through the Admin and Finance committee to discuss what will be done with it and they will let the residents know how the money will be spent.

    President Bollendorf also stated that last week was Law Enforcement week and he thanked Chief Gardner and the Hatboro Police Department. He also stated that this week is EMS week and he thanked the Fire Company and SARS for all that they do.

  • TREASURER’S REPORT – Treasurer Rich stated that the balance at the end of May 2021 was $5,857,957.21 with interest earned in the amount of $685.77.

  • SOLICITOR’S REPORT – Solicitor Geiser stated that there is unfortunately no update on the RAV Collision appeal and that she checked with the Court of Commonwealth before the meeting and there was no update yet.
    Solicitor Geiser also stated that there are two development’s that are moving forward, and one is Victorian Village.

    Solicitor Geiser also stated that they have been keeping up with the mask mandate.

    Solicitor Geiser also stated that they have been looking into the American Rescue Act regarding stimulus funds for municipalities.

    Solicitor Geiser also state that she is working on the two ordinances that Councilwoman Anzinger mentioned for the EAC and should be ready for Council to consider in June.

  • ENGINEER’S REPORT – Engineer Goff stated that under the MS4 services, they are performing a suspected source investigation.

    Engineer Goff also stated that under the Jacksonville and Montgomery Avenue project, SEPTA has approved the revision and they are drafting the legal agreement between them and the contractor.

    Engineer Goff also stated that the Corinthian Trail project is out to bid.

    Engineer Goff also stated that under the Loller building improvements project, the bid was awarded for the Mechanical and Fire Suppression contract to Guy M. Cooper and was added to the voting part of the agenda tonight.

    Engineer Goff also stated that under the Williams Lane flasher project, they submitted their initial design to Penndot today for their review.

  • MANAGER’S REPORT – Manager Hegele stated that the YMCA has reported they only need to use our pool for one night. They originally submitted for three nights and Council approved 2. She also stated that they will be using our pool on June 29th and that we have updated the information in Borough Hall and are working with the pool staff to get the word out to the members.

    Manager Hegele stated that the Borough was notified earlier this month that the organizers for the Bucks-Mont PRIDE 2021 event scheduled for July 10th in Miller Meadow were withdrawing their permit application to use the field and that they are

    moving their event to another location in Abington at the Abington Art Center, 515 Meetinghouse Road, Jenkintown PA on Sunday, July 18th. For more information visit http://www.BucksMontPRIDE.com

    Manager Hegele stated that last month Council authorized the submission of a project, Memorial Park Playground ADA project for two funding opportunities and staff has submitted to both and we recently heard from Rep. Dean’s office that they submitted our project, along with 9 others to the Appropriations Committee for funding. Manager Hegele also stated that she is happy that they liked our project and feel like we do the need for improvements and upgrades to Memorial Park and as the process moves forward, she will remain in contact with Rep. Dean’s office to provide any additional information or respond to questions they may have. She also stated that she wanted to thank Rep. Dean and her staff working with us and advocating for this project that benefits the residents of Hatboro and visitors to our park and that a complete list of all recommended projects can be found on Representative Dean’s website.

    Manager Hegele stated that the update on the Keystone Communities Grant Application for Cressbrook is the Borough has submitted all the required information to DCED and thank you to State Representative Guenst for her help and support for this grant as well as Assistant Secretary DeRenzis, Superintendent Frydlewicz and Deputy Superintendent Dermer for all their work on this project. Manager Hegele also stated she wanted to remind everyone that this is for funding in the amount of up to $60,000 for work at Cressbrook House, it includes alarm system upgrades, boiler installation, roof work, concrete work and walkway improvements. Stay tuned to the Borough website and Facebook for updates on both these projects.

    Manager Hegele stated the Borough has smoke detectors thank you for to 6 ABC and Kidde for the yearly donation. If you do not have a smoke detector, please contact the Fire Marshal at Borough Hall.

    Manager Hegele stated last week was National Police Week, this week occurs every May, from May 9th to the 15th and the Borough is currently lit at night, displaying blue candles in the windows in support of our police officers who protect us daily and sadly to those officers who made the ultimate sacrifice. Thank you to Chief Gardner and the men and women of the HPD that protect us daily and keep Hatboro safe. Manager Hegele stated that this week is National Public Works Week and stated thank you to Superintendent Frydlewicz, Deputy Superintendent Dermer and the men of Hatboro PW for all they do to keep Hatboro a beautiful place to live, work, and visit. Manager Hegele stated that the Hometown Heroes Banners have been hung again along York Road and stated thank you, Public Works for hanging them in time for Armed Forces Day. Manager Hegele stated she wanted to remind everyone that Memorial Day is on Monday, May 31st and that Borough Hall and Public Works will be closed in observance of the holiday and there will be no trash or recycling collection. She also stated thank you to those who made the ultimate sacrifice in safeguarding our nation, preserving our union, and fighting for freedom.

STAFF REPORTS

  • POLICE – Chief Gardner stated that as far as the event at Miller Meadow this Saturday, he met with the Fire Police Captain today and the Northbound curb lane at N. York Road will close around 8:30 A.M. to prepare for the event.

    Chief Gardner also stated that the police test for this year is being held on June 12, 2021 at the Hatboro Horsham High School and this year there are 13 Police Departments in Montgomery County that are participating.

  • TAX COLLECTIONS – Tax Collector Mount stated that at the beginning of April 2021 she had a balance collectible in the amount of $1, 515,049.37 and had collections in the amount of $1,148,236.89 which left a balance at the end of the month in the amount of $367,323.46.

  • PUBLIC WORKS – Superintendent Frydlewicz stated that the pool is ready to go and that he has been in contact with the Pool manager and her staff. He also stated that the shade structure should be pouring the base for final completion this week.

    Superintendent Frydlewicz also stated that that new signs have been going up in Miller Meadow and that everything in general is going well.

  • DEPUTY SUPERINTENDENT PARKS REPORT – Deputy Superintendent Dermer stated that he has been working with Manger Hegele and the DVRCP and Montgomery County Planning Commission and Penndot to do some planning for a bike lane and the goal is to reconfigure the 8 foot shoulder on N. York Road from Summit Avenue to Madison Avenue for bikes and pedestrians and it is nearing the end of the planning process and they are looking for a catchy name for this project.

  • DOWNTOWN DEVELOPMENT UPDATE – Secretary Bollendorf stated that we continue to send out updates and reminders to the business owners twice a month. Updates are what is currently happening or going to happen while the reminders are just that. Just to give you an idea, as far as reminders go, the following are some of the reminders business owners are receiving twice a month: Property Maintenance – maintain tree boxes, weeds in sidewalk, overall general property maintenance, Emergency Contact Forms -information about property and business owner for Police and Fire in case of an Emergency, Business Spotlight – Businesses that were spotlighted so far had reached out to me expressing interest in this. We are currently looking for spots for August – December, Advertise at Borough Hall – let businesses know that they can drop off flyers, business cards, menus, etcetera and these are placed in the front lobby by the door so anyone who conducts business at the window walk past the table where such items are displayed for visitors to help themselves, BPT – information regarding the 2020 BPT which also includes the tax office information, Hatboro Rotary – Rotary is starting a new program, introduce your business to the rotary. Rotary is inviting the businesses to attend a future meeting to introduce themselves and possibly join the rotary.

    Secretary Bollendorf also stated that Mike Cavanaugh from County Line Pharmacy came up with a great idea that he has extended to all business owners. He contacted me a few weeks ago to tell me that he had 500 bags made up which contains contents advertising business in Hatboro along with information about Hatboro (he typed up a paper with the History of Hatboro and included it in the bag). Some ideas he gave for advertising were pens, magnets, menus, business cards or a piece of candy with their business name on it. Mike called and extended the deadline another two weeks so he should start distributing the bags by the end of the month. Moreland Towers and Garner House are the two of the complexes he will be distributing to and thinks he will be making more bags after he completes this round. Much thanks to Mike for doing this and keeping our residents informed and of course who doesn’t absolutely love a goodie bag?!?! Community Day at the Pool – Businesses are welcome to set up a table to advertise to the community, BPT Extension – Informed businesses Council extended the deadline until 5/31/21

  • FIRE MARSHAL – The May 2021 Fire Marshal Report was electronically submitted.

  • FIRE COMPANY REPORT – There was nothing to report.

  • UNION LIBRARY REPORT – Librarian Celec shared the reopening plan for the library.

    Librarian Celec also stated that they had a few in person events after not being able to for almost over a year. Librarian Celec also stated that Yoga is also back Wednesday nights at 6:30 P.M. Librarian Celec also thanked the Crooked Billet gardeners as their children’s garden is now a Certified Wildlife Habitat. Librarian Celec also stated that summer reading events will be in person this year. Councilwoman Reichner stated that June 12, 2021 there will be a Pennypack event which is an Open House where people can come in look at old memorabilia and things for sale to commemorate the closing of the school.

ACKNOWLEDGE RECEIPT OF REPORTS – Vice President Stockton made a motion to acknowledge the receipt of UMHJSA Minutes, Historical Commission Minutes, Tax Collections, Public Works, Fire Marshal, and Treasurer’s Reports. Motion was seconded by Councilwoman Ostrander, all ayes. Motion carried 7-0.

APPROVAL OF WARRANT LIST, PAYMENT OF BILLS, MANUAL CHECKS AND TRANSFERS – Councilwoman Ostrander made a motion to approve Warrant List, Payment of Bills, Manual Checks, and Transfers for the month of May 2021. Motion was seconded by Vice President Stockton, all ayes. Motion carried 7-0.

APRIL 19, 2021 COMMITTEE/COUNCIL MEETING MINUTES – Councilwoman Anzinger made a motion to approve the April 19, 2021 Committee/Council Meeting Minutes. Motion was seconded by Councilwoman Benjamin, all ayes. Motion carried 7-0.

2021 PAVING PROJECT – This item was tabled until we get estimates.

AMENDMENT TO PARKS RULES FOR MILLER MEADOW GAZEBO – Councilwoman Anzinger made a motion to authorize the Solicitor to draft an amendment to the Parks Rules Ordinance to detail rules for the use of Miller Meadow Gazebo and add a decoration policy for the Gazebo. SOLICITATION ORDINANCE UPDATE – Councilwoman Reichner made a motion to authorize the Solicitor to draft an amendment to the Solicitation Ordinance. Motion was seconded by Councilwoman McMenamin, all ayes. Motion carried 7-0.

POOL RATIFICATION LIST – Councilwoman Reichner made a motion to approve the updated 2021 Pool Ratification List. Motion was seconded by Councilwoman Anzinger, all ayes. Motion carried 7-0.

SNACK STAND RFP – This item was tabled as no one has expressed any interest.

APPOINTMENT OF DEPUTY CODE OFFICIAL – Councilwoman Benjamin made a motion to approve Resolution 2021-30, appointing Kyle Dermer to the position of Deputy Code Official. Motion was seconded by Councilwoman Reichner, all ayes. Motion carried 7-0.

BOROUGH HALL HVAC PROJECT FIRE SUPPRESION CONTRACT – Councilwoman Anzinger made a motion to award the base bid for the Borough Hall HVAC Fire Suppression Contract to Guy M. Cooper in the amount of $339,000.00. Motion was seconded by Councilwoman McMenamin, all ayes., Motion carried 7-0.

BOROUGH HALL HVAC PROJECT MECHANICAL CONTRACT – Councilwoman McMenamin made a motion to award the base bid for the Borough Hall HVAC Project Mechanical Contract to Guy M. Cooper in the amount of $1,310,000.00. Motion was seconded by Councilwoman Anzinger, all ayes. Motion carried 7-0.

ADJOURNMENT – Councilwoman Reichner made a motion to adjourn the May 17, 2021 Council Meeting. Motion was seconded by Vice President Stockton, all ayes. Motion carried 7-0. President Bollendorf adjourned the May 17, 2021 Council meeting at 8:30 P.M.
