PUBLIC HEARING – 50 S. PENN STREET WIRELESS APPLICATION

CALL TO ORDER – President Bollendorf opened the Public Hearing at 7:00 P.M.
Solicitor Geiser stated today was scheduled for a conditional use hearing for Qualtek Wireless to swap out antennas at 50 S. Penn Street and as required by Hatboro Ordinance, they are required to have a conditional use if they are going to modify what is going in. She stated the hearing was advertised however the applicant contacted Borough Hall today and indicated they would like to have their attorney present to satisfy requirements of the Borough code and they have requested a continuance to August 15, 2022, at 7 P.M. here at Pennypack.

ADJOURNMENT – President Bollendorf adjourned the public hearing at 7:01 P.M.

COMMITTEE MEETING

PRESENT – President Bollendorf, Vice President Stockton, Councilwoman McMenamin, Councilman Myers, Councilwoman Jacobus, Manager Hegele, Assistant Secretary DeRenzis, Chief Gardner, Solicitor Geiser, Engineer Goff, Superintendent Frydlewicz, Superintendent Dermer, Fire Marshal Dermer, Treasurer Smith, Fire Company President Ide, and Director Celec were present.

ABSENT – Councilwoman Reichner and Councilwoman Ostrander were excused.

CALL TO ORDER – President Bollendorf called the July 18, 2022, Committee Meeting to order at 7:01 P.M.

PLEDGE OF ALLEGIANCE – Chief Gardner led the Pledge of Allegiance.

MEETING NOTES – President Bollendorf reviewed the Public Comment Policy on the back of the agenda with regards to addressing Council and time allotment.

PUBLIC COMMENT – There was no public comment.

MS4 PRESENTATION – Engineer Goff gave a presentation on stormwater management as a requirement of the Borough’s MS4 permit.

NEW BUSINESS

Public Safety Committee
PUBLIC SAFETY UPDATE– There was no update.

ENTERPRISE FIRE COMPANY EXPENDITURE LISTS – Councilman Myers stated this is to approve the Enterprise Fire Company Expenditure list for the month of May 2022 in the amount of $6,377.06 and the month of June 2022 in the amount of $ 8,431.60. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

CIVIL SERVICE POLICE ENTRANCE EXAM – Chief Gardner stated the Montgomery County Police Test Consortium is meeting to discuss having another police entrance examination in the Fall of this year and while t’s unusual to have two exams in one year, the top candidates from the last test have been hired, and participating departments are faced with continuing vacancies and a need to fill positions. He stated while we have no current vacancies, he always recommends we maintain a current and updated list of candidates to fill vacancies that may occur. He also stated there is no cost for us participating in the examination; therefore, he recommends Council direct their civil service commission to participate in the next round of testing to establish a new eligibility list for the position of patrol officer. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

WARMINSTER ROAD BRIDGE PROJECT UPDATE – Councilman Myers stated there was no update and work is still scheduled to start Spring 2023.

Finance/Grants Committee

UNION LIBRARY EXPENDITURE LIST – Vice President Stockton stated this is to approve the Union Library Expenditure List for the month of July 2022 in the amount of $ 29,672.59. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

BOND REFINANCE/GENERAL OBLIGATION NOTE – Vice President Stockton stated this is to approve Ordinance 1070, authorizing a General Obligation Note Series 2022 in the amount of $ 2,000,000.00. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

PA HISTORICAL/MUSEUM COMMISSION ARCHIVAL RECORDS GRANT – Vice President Stockton stated this is to approve the application to the PA Historical/Museum Commission Archival Records Grant Program for the Borough Hall Historical Document Archiving Project. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

BOROUGH HALL MECHANICAL PROJECT PAYMENT #9 – Vice President Stockton stated this is to approve payment #9 for the Borough Hall Mechanical Contract to Guy M. Cooper in the amount of $ 126,219.33. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

BOROUGH HALL FIRE SUPPRESSION PROJECT PAYMENT #8 – Vice President Stockton stated this is to approve payment #8 for the Borough Hall Fire Suppression Contract to Guy M. Cooper in the amount of $ 65,667.36. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

AWARDING OF BID: HATBORO STATION TRAIL PROJECT – Vice President Stockton stated this is to award the Hatboro Station Lighting Project to Lenni Electric Corporation in the amount of $ 185,089.00. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

399 SPRINGDALE FINANCIAL SECURITY RELEASE #4 – Vice President Stockton stated this is to approve the financial security release #4 for the 399 Springdale Project in the amount of $ 33,241.50. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

2ND QUARTER CLAIMS UPDATE – Vice President Stockton stated that out of 4 claims, two have been closed and two remain open.

2ND QUARTER BUDGET UPDATE – Vice President Stockton gave an update on the 2nd quarter budget and stated given the circumstances regarding inflation, we are where we expected to be.
3) Community Outreach & Events Committee

BUSINESS SPOTLIGHT: NEW AGE DEVELOPMENT GROUP – Councilman Myers announced the Business Spotlight for July is New Age Development Group.

UPCOMING EVENTS – Councilman Myers announced the upcoming events.

GOLD STAR GARDEN UPDATE – Councilman Myers gave an update on the Gold Star Garden Project and stated the dedication ceremony is September 25, 2022.

FRIENDS OF CRESSBROOK UPDATE – Councilman Myers gave an update on the Friends of Cressbrook.

KAT HALL WIFFLE BALL EVENT REQUEST – Councilman Myers stated that this is to approve the Special Event Request submitted by Kat Hall Wiffle Ball for the tournament scheduled for September 4, 2022, at the Hatboro Little League Field. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

Public Works Committee

DEPARTMENTAL UPDATE – Councilwoman Jacobus stated Public Works Department has been busy with park maintenance, cleanup of the Pennypack property, and painting parking meters.

AWARDING OF BID: 2022 HATBORO LIQUID FUELS ROAD PAVING PROGRAM – Engineer Goff stated the Borough should consider that the contract price may inflate and that asphalt prices have experienced unprecedented inflation rates in the year 2022 and per PennDOT Publication 408, Section 110.04, the Contractor is contractually permitted to adjust unit prices according to inflations rates.
Councilwoman Jacobus stated this is to award the bid for the 2022 Road Paving program to bray Brothers Inc. for the flowing roads/amounts:
1) N. Penn Street from E. Monument Avenue to Summit Avenue – $ 60,290.00
2) Edward Road from Belmar Road to the Borough Line – $ 57,175.00
3) Williams Lane from S. Chester Avenue to S. Linden Avenue – $ 43,377.50
4) N. Penn Street from E. Monument Avenue to E. Montgomery Avenue – $ 37,002.50
The total amount for the paving is $ 197,845.00. The Borough’s Liquid Fuel balance is roughly $320,000.00 which includes a balance of $198,000.00 that was carried over from last year.

Facilities

FACILITIES UPDATE – There was no update.

PENNYPACK BUILDING COMMITTEE UPDATE – Councilwoman Jacobus stated the committee had a meeting June 23 and they reviewed the layout of the building as well as the goals of the committee and the next meeting is July 20, 2022, at 6 P.M.

Environmental Affairs and Parks

EAC UPDATE – Councilman Myers stated their last meeting was July 11, 2022, and there is no August meeting.

PENNYPACK STEERING COMMITTEE UPDATE – Councilman Myers stated they had a meeting June 30, 2022, and the next meeting will be July 26, 2022, at 6 P.M.

CORINTHIAN TRAIL RIBBON CUTTING UPDATE – Councilman Myers stated the March ribbon cutting was cancelled due to inclement weather and is scheduled for July 20, 2022, at 2 P.M.

PARKS PROFESSIONALS’ DAY – Councilman Myers stated every July we celebrate Park and Recreation Month across the nation and here in Pennsylvania, in partnership with the Pennsylvania Recreation and Park Society, we honor the men and women who work tirelessly throughout the state to provide the parks and recreation programs and facilities that we enjoy every day. He stated to join Hatboro Borough in celebrating PARK AND RECREATION PROFESSIONALS’ DAY on July 16th to honor those who plan, provide, and operate our parks, trails, programs, and facilities for all our citizens, and thank the essential workers who kept parks open throughout the pandemic and those of us here at Hatboro Borough would like to use this day to recognize all the men and women that make our parks such great destinations for the residents and visitors of Hatboro! To celebrate Park and Recreation Professionals Day and honor your local parks and recreation providers, plan to visit a local park or recreation facility on July 16th and take the time to thank a programmer, manager, maintainer, landscaper, facilitator, lifeguard, coach, event organizer, or caretaker, and tell them what parks mean to you. Ron Battis, 317 E. Moreland Avenue, stated that doing business with the YMCA is not always a good idea as they book two dates with the pool and failed to show up and didn’t let us know and staff got the pool ready for them as well as closed the pool top the members for these events. He stated they have another event scheduled and he hopes the Borough doesn’t honor it.

President Bollendorf stated that it was last week and was cancelled and that he will remember next year when they ask for events at the pool.

Administration Committee

MEETING ANNOUNCEMENTS – Councilwoman McMenamin announced the upcoming meetings for August 2022.

UNION LIBRARY HISTORIC RESOURCE HEARING – Councilwoman McMenamin this is to authorize staff to advertise a public hearing on August 15, 2022, to consider the addition of the Union Library to the Historic Source Registry. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

RC-2 ZONING ORDINANCE UPDATE – Councilwoman McMenamin stated this is to authorize staff to advertise a public hearing on August 15, 2022, to consider the RC-2 Zoning Ordinance Amendment. This item has been moved to the July 18, 2022, Council Meeting Agenda for approval.

HATBORO STATION – TOLL BROTHERS UPDATE – Councilwoman McMenamin stated work is scheduled to begin August 22, 2022 and is estimated to end by the end of September 2022. President Bollendorf asked if all were to agree if it isn’t completed by the end of September, the Borough keeps the escrow and completes the work themselves. Solicitor Geiser stated she we okay with that.

OLD BUSINESS AND UPDATES – There was no old business or updates.

COUNCIL MEETING

CALL TO ORDER – President Bollendorf called the July 18, 2022, Council Meeting to order at 7:54 P.M.

PUBLIC COMMENT – There was no public comment.

MAYORS REPORT – Mayor Schultz was not present. Councilwoman Jacobus read the Mayor’s Women’s Reproductive Rights Resolution.

OFFICER’S REPORTS

PRESIDENT’S REPORT – President Bollendorf stated there are two steering committee for the Pennypack property, one for the building and one for the outside.

President Bollendorf stated State Representative Nancy Guenst had the privilege of attending a round table with the Vice President of the United States.

TREASURER’S REPORT – Treasurer Smith stated the balance in all accounts ending June 30, 2022, is $ 3,636,955.83 with interest earned in the amount of $ 745.78.

SOLICITOR’S REPORT – Solicitor Geiser stated she had been preparing for tonight’s hearing which was rescheduled until August.

Solicitor Geiser stated she has been working on the RC2 Ordinance Amendment.

ENGINEER’S REPORT – Engineer Goff stated has been assisting staff with grants and grant writing.
Engineer Goff stated she worked on the Borough’s MS4 report and presentation. Engineer Goff stated the Streambank project is under review. Engineer Goff stated she worked ion the bid openings for the lighting project and the road program. Engineer Goff stated she reviewed the Land Development for the former CVS property.

MANAGER’S REPORT – Manager Hegele stated the Planning Commission met last week and authorized the text amendment ordinance to go to the MCPC for formal review and to Council to schedule a hearing (which is on your agenda for this evening).

Manager Hegele stated the ZHB met last week and authorized the variances applied for the Mini Market and gas at the former Exxon Station at York/County Line.

Manager Hegele stated she has been getting a lot of calls from residents asking about Wawa Construction Schedule and a recent update from Wawa and the property owner stated construction is expected to start sometime in August.

Manager Hegele stated it is hot and the pool has been very busy and this past weekend she attended 80’s night and it was a fun time, everyone in attendance enjoyed. She thanked the prize donors, Nourishing Storm, Corradino Chiropractic, Aerodrome, Deleted Scene Tattoo removal, Street Food for some delicious food, Rick Michael for the great 80’s music and trivia, the events committee for the games and Greg Parker and the pool staff.

Manager Hegele stated the DEPA is conducting passive soil gas sampling in Borough Right-of-Ways, and we are hoping to deploy the sampling devices during the week of July 25th and then retrieve them approximately two weeks later during the week of August 8th. She also stated we anticipate it will take us about 3 – 4 days each week to complete the work.

STAFF REPORTS

POLICE – Chief Gardner stated the plan for the car show this year will be the same as previous years as they will start to close York Road around 12:30 P.M and will reopen after it ends, and they remove all the cars which will be around 11:00 P.M. He stated they will allow cross traffic and Lehman Avenue, Moreland Avenue, and Montgomery Avenue and the sign board is out on York Road and Septa will be notified this week.

Manager Hegele stated she just received an email stating we are ready to go for our ADA accessible playground.

TAX COLLECTIONS – The tax collectors report was submitted.

PUBLIC WORKS – Superintendent Frydlewicz stated Public Works has been preparing for the car show and thanked the crews.

Superintendent Frydlewicz stated grass has been slow due to the heat, so they have been able to keep up with other projects while they have a break from cutting the grass.

SUPERINTENDENT PARKS REPORT – Superintendent Dermer stated he has been able to work with both Pennypack steering committees and thanked everyone who has volunteered to be a part of it. Superintendent Dermer thanked President Bollendorf for the opportunity to be a part of his radio show.

DOWNTOWN DEVELOPMENT – Cindy Bollendorf stated she has updated the Business owners regarding property maintenance especially since the car show is approaching and they will receive nationer reminder later this week or early next week.

Cindy Bollendorf stated we will be publishing a fall Newsletter and spoke to Rosemary from Hometown Press, and she will be coming in the 2nd week of August to reach out to business owners regarding ad space. She also stated she will need submissions from everyone by August 22nd to submit the end of August so the newsletter can be delivered buy beginning of October. She stated she will be sending everyone an email reminder for this.

FIRE MARSHAL – Fire Marshal Dermer stated for the month of June 2022, he inspected 2 Rental units, completed 11 U&O’s, completed 2 U&O reinspection’s, completed 18 Business inspections, followed up on 50 property maintenance issues, issued 12 grass warnings letters, issued citations for multiple properties, investigated 1 minor fire, and responded to 8 Emergencies.

FIRE COMPANY – Fire Company President Ide stated Enterprise is still looking for volunteers.
Fire Company President Ide stated the Fire Company responded to 18 calls in the month of June.
Fire Company President Ide stated the Fire Company trains every Wednesday and all are welcome to stop in and watch them train. Fire Company President Ide stated they attended cruise night and will be attending the car show.

UNION LIBRARY REPORT – Director Celec stated the summer reading program has been well attended.
Director Celec stated the library is looking for a Part Time Library Assistant and a flyer with information has been left on the table for anyone who may be interested. Director Celec stated the application submitted for funding has been approved in the amount of $ 214,000.00. Director Celec stated the book sale and shred will be September 10,2022. Director Celec stated they are replacing the HVAC in the building.

APPROVAL OF WARRANT LIST, PAYMENT OF BILLS, MANUAL CHECKS AND TRANSFERS- Councilwoman McMenamin made a motion to approve Warrant list, Payment of Bills, manual Checks, and transfers for the month of July 2022. Motion was seconded by Councilman Myers, all ayes. Motion carried 5-0.

JUNE 20, 2022, COMMITTEE/COUNCIL MEETING MINUTES – Councilman Myers made a motion to approve the June 20, 2022, Committee/Council Meeting Minutes. Motion was seconded by Councilwoman Jacobus, all ayes. Motion carried 5-0.

PUBLIC COMMENT – Ron Battis, 317 W. Moreland Avenue, stated we may want the solicitor and engineer check onto the fact that the work that needs to be done by Toll Brothers at Hatboro Station that we are covered especially since prices of everything have gone up, it may be cheaper for the Borough to do it and he wondered if we are holding enough money to cover it. President Bollendorf stated their line of credit covers everything they need to do and Solicitor Geiser confirmed that the Borough is good.
