June 20, 2022 Committee Council Meeting Minutes

PRESENT – President Bollendorf, Vice President Stockton. Councilwoman McMenamin, Councilwoman Reichner, Councilman Myers, Councilwoman Jacobus, Councilwoman Ostrander, Mayor Schultz, Manager Hegele, Assistant Secretary DeRenzis, Chief Gardner, Solicitor Geiser, Engineer Goff, Superintendent Frydlewicz, Superintendent Dermer, Fire Marshal Dermer, Treasurer Smith, Fire Company President Ide, and Director Celec were present.

CALL TO ORDER – President Bollendorf called the June 20, 2022, Committee Meeting to order at 7:00 P.M.

INVOCATION – Mayor Schultz gave the Invocation.

PLEDGE OF ALLEGIANCE – Chief Gardner led the Pledge of Allegiance.

MEETING NOTES – President Bollendorf reviewed the Public Comment Policy on the back of the agenda with regards to addressing Council and time allotment.

PUBLIC COMMENT – There was no public comment.

EPA RAYMARK TESTING UPDATE – Manager Hegele gave an update on the EPA Raymark testing and stated Raymark will be doing testing at 220 Jacksonville Road and the surrounding area. She stated they will be taking samples and analyze the data and will share results with Council. She also stated once they come to town, they will check in at the hatboro PD to get any applicable permits that are needed, and the contractor will register and will flyer the neighborhoods affected by this. Councilwoman Ostrander asked if they would seal the holes when they are done, and Manager Hegele stated yes, they will repair the road back.

NEW BUSINESS

1) Public Safety Committee

WARMINSTER ROAD BRIDGE PROJECT UPDATE – Councilwoman Ostrander stated there were no updates at this time and work is still scheduled for Spring 2023.

2) Finance/Grants Committee

UNION LIBRARY EXPENDITURE LIST – Vice President Stockton stated this is to approve the Union Library Expenditure List for the month of June 2022 in the amount of $ 16,457.86. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

CORINTHIAN TRAIL PROJECT PAYMENT #7 – Vice President Stockton stated this is to approve the Corinthian Trail project payment #7 to Marino Construction in the amount of $ 134,497.28. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

BOROUGH HALL ELECTRICAL PAYMENT #6 – Vice President Stockton stated this is to approve the Borough Hall Electric payment # 6 to MJF Electric in the amount of $ 4,992.51. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

BOROUGH HALL MECHANICAL PROJECT PAYMENT #7 – Vice President Stockton stated this is to approve the Borough Hall Mechanical payment # 7 to Guy M. Cooper in the amount of $93,835.00. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

BOROUGH HALL MECHANICAL PAYMENT #8 – Vice President Stockton stated this is to approve the Borough Hall Mechanical payment 38 to Guy M. Cooper in the amount of $ 188,650.00. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

BOROUGH HALL FIRE SUPPRESSION PROJECT PAYMENT #7 – Vice President Stockton stated this is to approve Borough Hall Fire Suppression payment # 7 to Guy M. Cooper in the amount of $ 95,649.00. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

JACKSONVILLE AND MONTGOMERY FINAL SIGNAL PAYMENT – Vice President Stockton stated this is to approve the final payment request for the Jacksonville and Montgomery Upgrade project in the amount of $ 8,154.91 and now that this project is completed, staff is submitting for the County aid reimbursement in the amount of $ 100,000.00. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

FLOOD MITIGATION GRANT PROGRAM APPLICATION – Vice President Stockton stated resolution 2022-13, prepared by Engineer Goff and adopted 5/23/22 listed Eaton Park as the location rather Memorial Park and therefore Council needs to ratify this resolution to reflect Memorial Park. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

ARLE GRANT APPLICATION – Vice President Stockton stated the ARLE Grant program is now accepting applications and this program awards projects for roadway safety, mobility/capacity upgrades, traffic signal improvements, pedestrian/bicycle improvements etcetera. He stated there is no match requirement for this grant and typical awards range from $100K – $800K and Engineer Goff suggested applying to this grant program for the Horsham/York Road intersection upgrade project or school flashers in front of Crooked Billet Elementary School. Council agreed on applying for Horsham/York Road intersection upgrade. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

399 SPRINGDALE ESCROW RELEASE #3 – Vice President Stockton stated Engineer Goff recommended Financial Security Release #3 to JD Signature Homes for the 399 Springdale project in the amount of $ 90,125.00. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

3) Community Outreach & Events Committee

BUSINESS SPOTLIGHT: STREET FOOD SANDWICH SHOP– Councilwoman Reichner announced Street Food Sandwich Shop is the June Business Spotlight.

UPCOMING EVENTS – Councilwoman Reichner announced the upcoming events.

GOLD STAR GARDEN UPDATE – Councilwoman Reichner stated the beef and beer fundraiser was a success raising almost $10,000.00 in profit which will go towards the construction. She also stated the dedication will be September 25, 2022, at Miller Meadow with more information to follow as we get closer.

FRIENDS OF CRESSBROOK UPDATE – Councilwoman Reichner stated the Friends of Cressbrook held their meeting on May 17th at the Cressbrook Property and the Friends appointed their 7th Member, Gary Roberts, and continued discussing upcoming fundraisers for the organization. She also stated the improvement work being performed under the Keystone Communities Grant is progressing nicely and the group is beginning to discuss other work that needs to be performed at the facility in the future. She stated their next meeting will be taking place on Tuesday, June 21st. She also stated the Events Committee also met on Wednesday, June 15th and confirmed that the 2nd annual Brews and Blues festival will be raising funds for the Cressbrook Property just like last year’s event and to please stay tuned for more information regarding the event.

WRDV RESOLUTION – Councilwoman Reichner this is to approve Resolution 2022-15, honoring WRDV Radio for over 40 years of local radio programming. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

HATBORO ROTARY LOBSTER POT EVENT REQUEST – Councilwoman Reichner this is to approve the Special event request submitted by the Hatboro rotary for the Lobster pot event to be held in Memorial Park on September 10, 2022. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

4) Public Works Committee

DEPARTMENTAL UPDATE – Councilwoman Jacobus stated since we have acquired this property, Public Works has been hard at work cleaning up the property and building.
Superintendent Frydlwwicz stated crews have been very busy throughout the Borough.

5) Facilities

FACILITIES UPDATE – Councilwoman Ostrander stated that Public Works did a great job cleaning the Pennypack building and getting it ready for Public Meetings.

PENNYPACK BUILDING COMMITTEE UPDATE – Councilwoman Ostrander stated to help with planning the future uses of the Pennypack Building itself, the Facilities Committee established a committee of residents who will meet monthly separate of the Outdoor Pennypack Steering Committee. She stated this committee will be tasked with conceptualizing ideas for the various classrooms and gathering space inside Pennypack itself and this committee will have their first meeting on June 23rd that the first meeting for this committee is June 23, 2022.

6) Environmental Affairs and Parks

EAC UPDATE – Councilman Myers gave an update on the EAC and stated the next meeting date is July 11, 2022, at 6:00 P.M.

SHADE TREE ORDINANCE UPDATE – Councilman Myers stated the Environmental Advisory Council is working on a proposed amendment to the Shade Tree Ordinance to revise the types of approve street trees. He stated the Environmental Affairs and Parks Committee would also like to amend the Shade Tree Ordinance to change the number of appointed members from 3 to 5 persons. He also stated once the EAC’s proposed amendment is received, they will provide Council with a copy of an amended ordinance for review prior to advertising.

PENNYPACK STEERING COMMITTEE UPDATE – Councilman Myers stated an overwhelming number of applications were received for the Pennypack School Committee and after reviewing all applications received, 20 residents were selected for the Pennypack Steering Committee. He stated the Pennypack Steering Committee will be holding its first meeting on June 30th.

PARKS RULES UPDATE – Councilman Myers stated this is to authorize staff and Solicitor Geiser to draft an amendment to the park Rules ordinance to add the Pennypack Property to the list. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

7) Administration Committee

ANNOUNCEMENT OF NEW MEETING LOCATION – Councilwoman McMenamin stated moving forward all meetings will be held at the Pennypack property located at 130 Spring Avenue, Hatboro, PA.

MEETING ANNOUNCEMENTS – Councilwoman McMenamin announced the upcoming meetings for the next month.

BOARDS AND COMMISSION APPOINTMENTS – Councilwoman McMenamin stated this is to approve Resolution 2022-16, appointing Marianne Shaeffer to the Shade Tree Commission for a term of 5 years, Resolution 2022-17, appointing Cole Woodson to the Historical Commission for a term of 3 years, and Resolution 2022-18, appointing Christopher Neapolitan to the Historical Commission for a term of 1 year. She also stated that these will be voted on individually. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

CVS TEXT AMENDMENT HEARING – Councilwoman McMenamin stated this is to authorize staff to advertise a hearing for the Zoning Text Amendment submitted for the CVS Property to take place July 18, 2022. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

50 S. PENN STREET ANTENNA SWAP CONDITIONAL USE APPLICATION – Councilwoman McMenamin stated this is to authorize staff to schedule a conditional use hearing for the Antenna Swap application submitted for 50 S. Penn Street which will be held on July 18, 2022. This item was moved to the June 20, 2022, Council Meeting Agenda for approval.

OLD BUSINESS AND UPDATES – There was no old business or updates.

PUBLIC COMMENT – Ron Battis, 320 W. Moreland Avenue, asked if the issue with CVS parking and density and President Bollendorf stated yes.

BOROUGH OF HATBORO
MONDAY, JUNE 20, 2022.
COUNCIL MEETING

PUBLIC COMMENT – There was no public comment.

MAYORS REPORT – Mayor Schultz stated the purchase of Pennypack was a real victory for the Borough as it will greatly benefit the community and thanked those involved in acquiring the property and thanked the school board members who voted yes to dell the property to the Borough. Mayor Schultz stated the second of five cruise nights this past Friday and was well attended and that the 29th Moonlight Memories car show is approaching and is July 30, 2022. Mayor Schultz stated the Bray Lodge Pig Roast will be on July 9th at Memorial Park.
Mayor Schultz wished everyone a fun and safe summer.

OFFICER’S REPORTS –
PRESIDENT’S REPORT – President Bollendorf thanked everyone who expressed interest in becoming a part of the new Pennypack steering committees and thanked all of those involved in acquiring the property and acknowledged their hard work. He also thanked the community for their support.
President Bollendorf stated the new My Hatboro App is up and running and thanked Assistant Secretary Derenzis for her hard work.

TREASURER’S REPORT – Treasurer Smith stated the balance in all accounts ending May 2022 is $ 5,770,105.80 with interest earned in the amount of $ 785.05.

SOLICITOR’S REPORT – Solicitor Geiser stated she had been working on the closing of Pennypack.
Solicitor Geiser stated she has been helping staff with routine Borough questions and matters.

ENGINEER’S REPORT – Engineer Goff stated for the past few months they have been assisting staff with grant writing. Engineer Goff stated the Hatboro Station trail lighting project is out to bid and the bid opening is June 22, 2022. Ron Battis, 317 W. Moreland Avenue, asked if we were done with Marino Corporation at the Corinthian trail and Engineer Goff said they are currently addressing punch list items and then yes.

MANAGER’S REPORT – There was no report as she was busy with Pennypack.
She stated the Corinthian trail ribbon cutting is this Thursday at 10:00 A.M.

STAFF REPORTS –
POLICE – Chief Gardner stated cruise night was well attended and a nice event.
Chief Gardner stated the Police Department received their new car which was ordered in October which is a hybrid, and they are seeing a savings with that.

TAX COLLECTIONS – The tax collectors report was submitted.

PUBLIC WORKS – Superintendent Frydlewicz stated the new trash truck is in service.
Superintendent Frydlewicz stated next week he is attending a seminar regarding an electric trash truck.

SUPERINTENDENT PARKS REPORT – Superintendent Dermer stated he has been working with the Shade Tree Commission to remove hazardous trees. Superintendent Dermer stated all playgrounds in the Borough have gotten new mulch. Superintendent Dermer stated he is excited to work with the two new steering committees for the Pennypack property.

DOWNTOWN DEVELOPMENT – Cindy Bollendorf stated she had the privilege to be a guest speaker for Rotary this month and talked to the members about property maintenance, Fire marshal inspections, Borough newsletter, social media pages, and about opening a business in the Borough. She stated she also talked about the new Hatboro App. Cindy Bollendorf stated Superintendent Dermer will be measuring for the planters and benches so she can order and have in time for Fall when which is tentative for this project.

FIRE MARSHAL – Fire Marshal Dermer stated for the month of May 2022 he Inspected 8 Rental units, completed 9 U&O’s, completed 4 U&O reinspection’s, Complete 7 Business inspections, Attended Fire investigator class hosted by bucks, followed up on 30 property maintenance issues, issued 34 high grass warnings, issued citations for multiple properties, assisted in 1 fire investigation, and responded to 3 Emergencies. Fire marshal Dermer also stated The Fire Marshal’s Office was awarded $3573 in a grant from FM Global to purchase a tablet and software to help with inspection and gave a special thanks to Director Kyle Dermer for writing the grant.

FIRE COMPANY – Fire Company President Ide stated Enterprise Fire Company responded to 30 calls last month. Fire Company President Ide stated Enterprise Fire Company attended cruise night last Friday.
Fire Company President Ide stated they purchased lawn signs to advertise for recruitment for volunteers.

UNION LIBRARY REPORT – Director Celec stated the summer reading program is under way and prizes are available. Director Celec stated there are summer activities which began now until August 5, 2022.
Director Celec stated there will be a book sale and shred September 10th sponsored by Representative Nancy Guenst.

ORDER OF BUSINESS AND VOTING ITEMS
ACKNOWLEDGE RECEIPT OF REPORTS – Councilwoman Reichner made a motion to acknowledge the receipt of UMHJSA Minutes, EAC Minutes, Public Works, Fire Marshal, and Treasurer’s Reports. Motion was seconded by Councilwoman Ostrander, all ayes. Motion carried 7-0.

APPROVAL OF WARRANT LIST, PAYMENT OF BILLS, MANUAL CHECKS AND TRANSFERS –Councilwoman McMenamin made a motion to approve Warrant list, Payment of Bills, manual Checks, and transfers for the month of June 2022. Motion was seconded by Vice President Stockton, all ayes. Motion carried 7-0.

MAY 23, 2022, COUNCIL MEETING MINUTES – Councilwoman Reichner made a motion to approve the May 23, 2022, Council Meeting Minutes. Motion was seconded by Councilman Myers, all ayes. Motion carried 7-0.

JACKSONVILLE AND MONTGOMERY TRAFFIC SIGNAL PROJECT – Vice president Stockton made a motion to approve the final payment to Carr 7 Duff in the amount of $ 8,154.91 for the Jacksonville and Montgomery Traffic Signal Upgrade Project. Motion was seconded by Councilwoman ostrander, all ayes. Motion carried 7-0.

399 SPRINGDLAE ESCROW RELEASE #3 – Councilwoman Reichner made a motion to approve financial security release #3 in the amount of $90,125.00 for the 399 Springdale Avenue project. Motion was seconded by Councilman Myers, all ayes. Motion carried 7-0.

FLOOD MITIGATION GRANT PROGRAM – Councilman Myers made a motion to ratify Resolution 2022-13 for the flood mitigation project to reflect an application for pervious pavers in Memorial Park. Motion was seconded by Councilwoman McMenamin, all ayes. Motion carried 7-0.

ARLE APPLICATION – Vice President Stockton made a motion to apply to the ARLE Grant Program for the Horsham & York Road Intersection project which is a no match grant. Motion was seconded by Councilwoman Reichner, all ayes. Motion carried 7-0.

WRDV RESOLUTION – Councilwoman Reichner made a motion to approve Resolution 20202-15, honoring WRDV radio for over 40 years of local radio programming. Motion was seconded by Councilwoman Jacobus, all ayes. Motion carried 7-0.

HATBORO ROTARY LOBSTER POT EVENT REQUEST – Councilwoman Reichner made a motion to approve the Special Event Request submitted by the Hatboro Rotary for the Lobster Pot event to be held in Memorial Park on September 10, 2022. Motion was seconded by Councilwoman Ostrander, all ayes. Motion carried 7-0.

HATBORO ROTARY LOBSTER POT WAIVER – Councilwoman Reichner made a motion to consider a waiver for the Rotary Lobster pot allowing alcohol at the event in the park and parking. Motion was seconded by Councilwoman Jacobus. President Bollendorf and Councilman Myers abstained. Motion carried 5-0 with 2 abstentions.

PARK RULES UPDATE – Councilwoman McMenamin made a motion to authorize staff and Solicitor Geiser to draft an amendment to the Parks Rules ordinance to add the Pennypack Property to the list of parks. Motion was seconded by Councilwoman Reichner, all ayes. Motion carried 7-0.

BRAY LODGE PIG ROAST EVENT REQUEST – Councilwoman Jacobus made a motion to approve the Special Event request submitted by Bray Lodge for the Pig Roast event in Memorial Park on July 9, 2022, from 1:00 PM until 6:00 PM. Motion was seconded by Councilman Myers, all ayes. Motion carried 7-0.

BRAY LODGE PIG ROAST WAIVER – Councilwoman Jacobus made a motion to approve a waiver for parking for the Bray Lodge event at Memorial Park. Motion was seconded by Councilman Myers. President Bollendorf abstained; motion carried 6-0 with 1 abstention.

OLD BUSINESS AND UPDATES – There was no old business or updates.

NEW BUSINESS – There was no new business.

PUBLIC COMMENT – Ron Battis, 320 W. Moreland Avenue, thanked everyone for their hard work in obtaining the Pennypack property which prevented anyone from developing on the property.

ADJOURNMENT – Councilwoman Reichner made a motion to adjourn the June 20, 2022, Council Meeting. Motion was seconded by Councilwoman Ostrander, all ayes. Motion carried 7-0. President Bollendorf adjourned the June 20, 2022, Council Meeting at 7:57 P.M.
