PRESENT VIA ZOOM – President Bollendorf, Councilwoman Anzinger, Councilwoman Benjamin, Councilwoman McMenamin, Councilwoman Reichner, Councilwoman Ostrander, Mayor Guenst, Chief Gardner, Manager Hegele, Assistant Secretary DeRenzis, Superintendent Sine, Solicitor Geiser, Engineer Goff, Tax Collector/ Fire Company President Mount, Librarian Celec.

ABSENT – Vice President Stockton and Treasurer Rich were absent.

CALL TO ORDER – President Bollendorf called the November 16, 2020 Committee Meeting to order at 7:00 P.M.

INVOCATION – The Invocation was given by Mayor Guenst.

PLEDGE OF ALLEGIANCE – The Pledge of Allegiance was led by President Bollendorf.

MEETING NOTES – President Bollendorf reviewed the Public Comment Policy on the back of the agenda with regards to addressing Council and time allotment.

RECOGNITION OF STATE REPRESENTATIVE TOM MURT – Mayor Guenst presented Tom Murt with a proclamation, thanking him for his service to Hatboro.

PRESENTATION BY BRAD REMIG FROM PFM WAS GIVEN FOR RESTRUCTURING DEBT

NEW BUSINESS
1) Public Safety Committee

  • ENTERPRISE FIRE COMPANY EXPENDITURE LIST – Councilwoman Ostrander stated that the Enterprise Fire Company Expenditure List for the month of October 2020 is $ 7,465.11. This item was moved to the November 16, 2020 Council Meeting Agenda for approval.

2) Finance/Grants Committee

  • PENNDOT MULTIMODEL TRANSPORTATION FUND GRANT – Councilwoman McMenamin stated that this is to authorize the application to the PennDOT Multimodel Transportation Fund Grant in the amount of $ 319,767.00. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • WALKWORKS GRANT UPDATE – Councilwoman McMenamin stated that they are scheduled to hold their first walk under this grant which is scheduled for the beginning of December and the dates are currently being finalized.
  • COMMUNITY CHANNEL UPGRADES – Councilwoman McMenamin stated that this is to approve the Community Channel Upgrades in the amount of $ 7,792.46.This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • CORINTHIAN TRAIL PROJECT ADVERTISEMENT – Councilwoman McMenamin stated that this to advertise a request for bids for the Corinthian Trail Project. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • UNION LIBRARY KEYSTONE GRANT – Councilwoman McMenamin stated that this is to approve Resolution 2020-53, authorizing Borough Manager Hegele to sign grant documents for the Union Library Keystone Recreation, Park, and Conservation Fund Grant. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • UNION LIBRARY EXPENDITURE LIST – Councilwoman McMenamin stated that this is to approve the Union Library Expenditure List for the month of October 2020 in the amount of $ 14,989.03. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • 2021 FEE SCHEDULE – Councilwoman McMenamin stated that this is to approve Resolution 2020-54, establishing the 2021 for schedule for the Borough of Hatboro.
  • PRELIMINARY ADOPTION OF 2021 BUDGET – Councilwoman McMenamin stated that this is to approve the preliminary adoption of the 2021 operating budget. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • MILLER MEADOW IMPROVEMENT PROJECT PAYMENT #3 – Councilwoman McMenamin stated that this is to approve Payment Request #3 for the miller Meadow Improvement Project in the amount of $ 61,973.30. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • EATON PARK STREAMBANK PROJECT PAYMENT REQUEST #1 – Councilwoman McMenamin stated that this is to approve payment request #1 for the Eaton Park Stream bank Restoration Project in the amount of $ 102,998.00.

3) Community Outreach & Events Committee

  • FRIENDS OF CRESSBROOK ESTABLISHMENT – Councilwoman Reichner stated that this is to establish the Friends of Cressbrook Organization. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • HISTORIC OVERLAY ORDINANCE UPDATE – Councilwoman Reichner stated the Planning Commission met regarding this and are continuing their discussion on this topic on December 8, 2020.
  • FREE PARKING FOR SHOPPERS DURING HOLIDAY SEASON/SBS – Councilwoman Reichner stated small business Saturday is November 28, 2020 and there will be free parking for shoppers until the end of December.
  • HATBORO HAUNTS HOUSE DECORATING CONTEST WINNERS – Councilwoman Reichner stated the winners are:
    Third Place – 48 E. Montgomery Avenue
    Second Place – 114 N. Chester Avenue
    First Place – 47 W. Lehman Avenue
    She also stated thank you to all who participated and thanked the judges for their time.

  • NOVEMBER EVENTS – Councilwoman Reichner stated that the following are Events in November :
    • November 21, 2020. – Cub Scout Pack 17 picking up canned goods in the bags that were left on residents steps. The food will be given to St. John’s Lutheran Church and Lehman United Methodist Church food pantry’s.
    • November 22, 2020. 2-4P.M.- drive through Hatboro neighborhoods. Stay tuned for the Parade route.
    • December 15, 2020. 6:30 P.M – Santa will be reading letters virtually at Borough Hall. Starting today, letters for Santa can be dropped off in the mailbox outside of Borough Hall 24/7.
  • NOVEMBER BUISNESS SPOTLIGHT: SCHNEIDER FUNERAL HOME – Councilwoman Reichner stated that Schneider Funeral Home is the business spotlight. The are celebrating 150 years of service.
  • NEW BUSINESSES – Councilwoman Reichner stated that the new businesses are as follows:
    • Capital Keep – Insurance and Notary located at 419 N. York Road
    • High Grade Nails and Spa – located at 224 N. York Road

4) Public Works Committee

  • RESIGNATION OF PUBLIC WORKS SUPERINTENDENT– Councilwoman Benjamin stated that this is to accept the resignation of Public Works Superintendent Brent Sine. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • SUPERINTENDENT COMPENSATION BUY OUT – Councilwoman Benjamin stated that there is comp time owed to Superintendent Sine and therefore Council will have to look into this to get the exact amount that is owed to him.

5) Environmental Affairs & Parks Committee – Councilwoman Anzinger stated that she had nothing on her agenda this evening.

6) Policy Committee

  • PERSONNEL MANUAL UPDATE – Councilwoman McMenamin stated that Manger Hegele finished the draft of the employee handbook and she needs to schedule time to review it. She also stated that job descriptions are in the process of being updated.

7) Administrative Committee

  • JACKSONVILLE GREEN LETTER OF CREDIT – Councilwoman McMenamin stated that this is to approve the letter of credit for Jacksonville Green for the 18 month maintenance period. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • 18 HORSHAM ROAD ASSESSMENT APPEAL – Councilwoman McMenamin stated that this is to approve the assessment appeal for 18 Horsham Road, Aspen Mill. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • SALE OF VEHICLES AND ASSORTED PARTS – Councilwoman McMenamin stated that this is to approve the sale of vehicles and miscellaneous parts on Municibid. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • FINAL APPROVAL OF POLICE CONTRACT – Councilwoman McMenamin stated that this is to approve the final contract for the Hatboro Police Department. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • SPECIAL EVENT REQUEST – COAT DRIVE – Councilwoman McMenamin stated that an event request was received for a Coat Drive at Eaton Park form the Crossways Church in Upper Moreland. She stated that currently the park is under construction and she did not see any type of COVID plan for this request. Chief Gardner stated that if this is to happen, he thinks the Pool parking lot would be a better idea and he is concerned there is no COVID plan in place. President Bollendorf asked for a COVID plan and Susan Swanson stated that she would be able to do that this week and get it back to Council.
  • DECEMBER MEETING DATE – Councilwoman McMenamin stated that this is to change the December Committee/Council meeting date to December 21, 2020 at 7:00 P.M via zoom. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.
  • DECEMBER MEETING ANNOUNCEMENTS – Councilwoman McMenamin stated that the following meetings will be held virtually via zoom in December:
    • Tuesday, December 2, 2020 – Historical Commission at 7:00 P.M
    • Monday, December 7, 2020 – Environmental Advisory Committee at 6:30 P.M.
    • Tuesday, December 8, 2020 – Planning Commission at 7:00 P.M – Contingent on information
    • Thursday, December 17, 2020 – Parking Commission at 6:30 P.M.

  • OLD BUSINESS AND UPDATES – Councilwoman Anzinger stated that they are going to be reauthorizing the Emergency Declaration for COVID 19 as numbers are on the rise. This item has been moved to the November 16, 2020 Council Meeting Agenda for approval.

COUNCIL MEETING
MONDAY, NOVEMBER 16, 2020

CALL TO ORDER – President Bollendorf called the November 16, 2020 Council Meeting to order at 7:41 P.M.

PUBLIC COMMENT (Voting Items Only) – There was no public comment.

MAYOR’S REPORT – Mayor Guenst read a letter announcing her resignation as Mayor of Hatboro due being elected State Representative.

OFFICER’S REPORTS
PRESIDENT’S REPORT– President Bollendorf stated that the turn out for voting this year was outstanding and he thanked everyone for participating in the process. President Bollendorf stated that we are not out of the woods with COVID as the numbers are higher than ever and we will abide by whatever our State and County officials tell us to do. He also stated that whatever our restrictions are, we will do our best to make sure everyone knows. President Bollendorf stated that he was able to take a tour of the new Crooked Billet Elementary School and if you have a chance to we it, it is amazing.

TREASURER’S REPORT – Manager Hegele stated that at the end of October 2020 there was a balance of $ 4,402,879.50 which includes interest in the amount of $ 721.52.

SOLICITOR’S REPORT -Solicitor Geiser stated that a decision was issued in the Borough’s appeal involving the Wawa location and unfortunately the Commonwealth court ruled against Hatboro. She also stated that in the Plumstead hearing, a different panel of judges ruled in favor of the township and the difference is in Plumstead, the size of the Wawa was the issue. She also stated that as of November 9, when the court issued this decision, the Borough has thirty days to appeal to the Supreme Court. She also stated that if the Borough appeals, it can take me to three years for them to rule if they decide to hear the case and if the Borough does not appeal, Wawa can construct pursuant to the plans that they initially submitted. President Bollendorf stated that this matter will be voted on December 7 and asked residents to email Councilpersons letting them know what they think Council should do.

ENGINEER’S REPORT – Engineer Goff stated that under the MS4 Program, they are recently conduction inspections as it is required under the MS4 permit. Engineer Golf also stated that under the Eaton Park Stream Bank Restoration Project, she is recommending the approval of payment #1.
Engineer Goff also stated that under the Miller Meadow Project, she is recommending the approval of payment #3. Engineer Goff also stated that under the Hatboro 2020 Liquid Fuels Road Program, the contractor is working on the punch list items and they are gathering the close out documentation for this project. Engineer Goff stated that under Miller Meadow Phase II, a preliminary lay out is beginning to be developed and once they have it, it will be sent to Borough staff.

MANAGER’S REPORT – Manager Hegele stated that Borough staff has worked very hard even after being forced to adjust its spending accordingly to assist Council with a budget that does not raise taxes and also stated we have trimmed in staffing, reduced seasonal hires, postponed some projects, and adjusted employees schedule during this crazy, unprecedented time while continuing to offer the same services. She also stated that we have been faced with the loss of revenue from earned income taxes and while the outlook is challenging, she is confident that the Borough can weather this and the economy will rebound. She also stated that the Borough’s recovery plan for 2021 includes some initiatives which include the creation of a COVID-19 budget impact protection worksheet and implemented increased budget monitoring at more frequent intervals. She also stated that we are evaluating current debt service obligations and working on refinancing to possibly better terms and we are looking at services we use for efficiency as well as monitoring business activity and unemployment. She also stated that we have and will continue to try to secure reimbursements from FEMA and all COVID related expenses and in accordance with the Borough code, Council held a public workshop on November 2nd to review the budget and staff went back to the table to and cut to reduce the deficit which at that time was near $ 750,000.00 and tonight you have in front of you a preliminary budget. She also stated that staff will go back and fine tune some more as we get more firm numbers and an up to date preliminary assessment for the Borough and present you a balanced final budget on 12/21 for your approval. Manager Hegele also stated that she wanted to thank Brent Sine and PW for picking up free PPE kits from the Montgomery County Chamber of Commerce to be distributed by the Hatboro Chamber of Commerce and these kits were needed by our business community and PW is going back this week to get more. Manager Hegele also stated that this year local resident and Assistant Fire Chief Eric Gordon is doing a bigger and better light display entitled Merry Lights on Pershing Avenue. She also stated that Eric and his family wanted to honor his neighbor Don Camp who passed away from COVID earlier this year.
Manager Hegele also stated that on Wednesday several of us will be attending the virtual 2020 Montgomery Awards Ceremony where Hatboro’s Jacksonville Green will be honored. She also stated that the county awards program recognizes the best in planning and design, advocacy and environmental stewardship and acknowledges the high-quality work and commitment of communities, organizations and professionals. Manager Hegele also stated that she recently met with County Planner Mohr to review the SW audit she is working on for Hatboro and that her and her team have studied over 400 segments of SW and 162 intersections.
Manger Hegele also stated that it is not exactly pool season yet but soon the borough will be posting the job for Pool Manager and we have our fingers crossed things will be normal and the pool will open. Manager Hegele also stated that there has been a spike in COVID cases and the Borough is doing everything to assist by promoting our businesses, working with business owners on curbside pick up options again, but she is asking residents to support small businesses again. Manager Hegele also stated that sadly we must announce the passing of long time resident and husband of former tax collector George “Skip” Emig. She stated that Mr. Emig served the Borough on several boards for many years and served as a constable at the polling places and we extend our sympathies to Judy, Kip, and Leanne. Manager Hegele stated congratulations and thank you to Mayor Nancy Guenst. She stated thank you for all your guidance, help and friendship during her career with the Borough as she was fortunate to work with her on Council and again when she was appointed Borough Manager. She stated best of luck as State Representative.

STAFF REPORTS

POLICE – Chief Gardner stated that he sends his condolences to Richard Stanno and the Bryan Athen Police Department who passed away suddenly over the weekend. Chief Gardner also stated that he wanted to send his condolences to the family of Skip Emig who also passed away. Chief Gardner also stated that he reported to Council last week that there does seem to be an alarming increase in COVID cases in Montgomery County and today he checked numbers and they were 766 new cases identified with two deaths between November 14 and November 16. He also stated that as a result he recommended the Borough consider some contingency plans for services. Chief Gardner also stated that they have conducted oral interviews for the police test and will be meeting with the Civil Service Committee so they can consider certification of the list.

TAX COLLECTIONS – Tax Collector Mount stated that the beginning collectible balance is $ 127,487.48 with a collected balance of $ 12,382.28 which leaves an amount of $ 115,105.20 to be collected.

PUBLIC WORKS – Superintendent Sine stated that PW crews continue with fall leaf clean up and remind residents not to rake or blow leaves into the roads and they are happy to pick them up in biodegradable bags on their regular trash day. Superintendent Sine stated that PW has begun getting their winter equipment and trucks ready. Superintendent Sine stated that today we received word that we got our 2019 PA DEP 904 Recycling Grant award and the Borough will be receiving $ 22,193.09. He also stated that this amount represents the quality of recycling collected curbside by our residents and tonnage collected by private Hager’s at business and developments we do not service and this is where all our recycling efforts are realized. He thanked PW employee Greg Puceta fo his help on this.

FIRE MARSHAL – The October 2020 Fire Marshal Report was submitted electronically.

FIRE COMPANY – There was nothing to report.

UNION LIBRARY– Librarian Celec stated that on Friday the Library returned to parking lot pick up and the building has been closed for the time being. He also stated that they only took one step back and are being as available as they can be. Librarian Celec also stated that they have been awarded two grants and one they intend to apply for. He stated they received a Cares Act Grant administered by Montgomery County in the amount of $ 3,608.96 for COVID related expenses. He also stated that a Montco Strong Non Profit Resiliency Grant was awarded to the Library for $17,860.00 and the main purpose of the grant is to purchase laptops and WiFi hot spots to circulate the public. He also stated that they plan to apply for a Keystone Grant which is for physical projects and the work on the building would begin this time next year. He also stated that nothing historic is going to be removed or replaced. He also stated the reason it is necessary for manager Hegele to sign grant documents is because the way the grant is set up, the Borough is the applicant. Librarian Celec thanked Council and Public Works for decorating their tree and that this year they are doing a video tree lighting with Santa this year and expects it to debut December 4, 2020 at 6:30 P.M.

ACKNOWLEDGE RECEIPT OF REPORTS – Councilwoman Benjamin made a motion to acknowledge the receipt of Tax Collections, Public Works, Fire Marshal, and Treasurer’s Reports. Motion was seconded by Councilwoman Reichner, all ayes. Motion carried 6-0

APPROVAL OF WARRANT LIST, PAYMENT OF BILLS, MANUAL CHECKS, AND TRANSFERS – Councilwoman Reichner made a motion to approve Warrant List, Payment of Bills, Manual Checks, and Transfers for the month of October 2020. Motion was seconded by Councilwoman Anzinger, all ayes. Motion carried 6-0.

OCTOBER 21, 2020 COMMITTEE/COUCIL MEETING MINUTES – Councilwoman Benjamin made a motion to approve the October 21, 2020 Committee/Council Meeting Minutes. Motion was seconded by Councilwoman Ostrander. President Bollendorf abstained as he was not present for the meeting. Motion carried 5-0 with 1 abstention.

NOVEMBER 2, 2020 BUDGET WORKSHOP MINUTES – Councilwoman Anzinger made a motion to approve the November 2, 2020 Budget Workshop Meeting Minutes. Motion was seconded by Councilwoman Ostrander, all ayes. Motion carried 6-0.

Manager Hegele stated that it has been awhile since our building permits were reviewed and she reached out to our BCO at RVE and they did a review of our building permits and made some adjustments to the fees which also includes, mechanical, electrical, and plumbing fees. She also stated that we will be adjusting the fees for our bulk permits.

DECEMBER MEETING DATE – Councilwoman Benjamin made a motion to change the December Committee/Council meeting date to Monday, December 21, 2020 at 7:00 P.M via zoom. Motion was seconded by Councilwoman Anzinger, all ayes. Motion carried 6-0.

SPECIAL EVENT REQUEST – COAT DRIVE – Councilwoman Ostrander made a motion to approve the Special Event Request for a Coat Drive in the Hatboro Memorial Pool Parking Lot pending a COVID-19 plan. Motion was seconded by Councilwoman Benjamin, all ayes. Motion carried 6-0.

REAUTHORIZATION OF EMERGENCY DECLARATION – Councilwoman Ostrander made a motion to reauthorize the Emergency Declaration for the Borough of Hatboro for the COVID-19 Pandemic. Motion was seconded by Councilwoman Benjamin, all ayes. Motion carried 6-0.

NEW BUSINESS
RESIGNATION OF MAYOR – Councilwoman Anzinger made a motion to accept the resignation of Mayor Nancy Guenst. Motion was seconded by Councilwoman Reichner, all ayes. Motion carried 6-0.

PUBLIC COMMENT – There was no public comment.

ADJOURNMENT – Councilwoman Benjamin made a motion to adjourn the November 16, 2020 Council Meeting. Motion was seconded by Councilwoman Ostrander, all ayes. Motion carried 6-0. President Bollendorf adjourned the November 16, 2020 Council Meeting at 8:48 P.M.
