October 14, 2024 Committee Meeting Minutes

PRESENT – President Bollendorf, Vice President Reichner, Councilwoman, Councilwoman Shay, Councilman Myers, Councilwoman Jacobus, Councilwoman Hendrickson, Councilman Hoover, Mayor Schultz, Manager Hegele, Assistant Secretary DeRenzis, Solicitor Geiser, Engineer MacNair, EFC President Brown, and Treasurer Smith were present.

ABSENT – Chief Ruegg was excused.

CALL TO ORDER – President Bollendorf called the October 14, 2024, Committee Meeting to order at 7:00 P.M.

PLEDGE OF ALLEGIANCE – President Bollendorf led the Pledge of Allegiance.

INVOCATION – Mayor Schultz led the invocation.

MEETING NOTES –
President Bollendorf announced Council had an executive session from 6:30 P.M. until 6:41 P.M. regarding a legal matter.

President Bollendorf reviewed the Public Comment Policy on the back of the agenda with regards to addressing Council and time allotment.

PUBLIC COMMENT – Kathy McGeary, 40 Franklin Avenue, asked for explanations for #3 & #7 on the Voting Meeting Agenda and President Bollendorf stated that both will be discussed at the time the report is given before the vote.

Carmen Lanzetta, 127 S. York Road, stated that the agenda states Aerodrome Litigation and that Aerodrome is not involved and has nothing to do with the lawsuit they filed personally and doesn’t appreciate that it was posted on the website and has been questioned by clients. President Bollendorf stated it will be discussed during Administrative Committee Report. Mr. Lanzetta stated he didn’t know how the meetings work, and President Bollendorf explained the procedure regarding public comment and discussions on individual agenda items. Mr. Lanzetta stated that he did not think it was fair the taxpayers are responsible for the legal fees regarding the lawsuit and is very upset that he has not had any response for 18 months and the sidewalk issue has been going on for years.

Donna Lanzetta, 127 S. York Road, stated that she is the salon owner and is upset that the salon was named as the salon has nothing to do with the lawsuit that they filed personally.

She also stated that her business has been in the Borough for 30 years and brings 300 clients a week through Borough and that she has never met Diane and feels given the situation and how long it has been going on, she felt Manager Hegele could have come to her shop and sit down and have a conversation and does not appreciate how the matter is and has been handled.

John Weinrich, 52 Byberry Road, asked if they were voting on a refuse ordinance and President Bollendorf stated that no, tonight’s vote is to authorize the solicitor to draft an amendment to it. Solicitor Geisr state that before Council spends taxpayer money, they have to vote. Mr. Weinrich stated that he thinks every residential dwelling should be charged equally for trash removal, the fee should be a millage rate line item, any residential dwelling should be classified as 1-4 units (5 or more should be classified as commercial), and there should be no difference between owner occupied or not, all should be the same amount charged, and owners with 3-4 units retain the right to keep the Borough collection or seek a private hauler and then the item should be removed form the tax bill. Mr. Weinrich gave a copy of his suggestions to Manager Hegele.

NEW BUSINESS
1. Public Safety Committee
•ENTERPRISE FIRE COMPANY EXPENDITURE LIST – Councilwoman Jacobus stated Included in your packet is a copy of the Fire Company Expenditure List for the month of September 2024 in the amount of $ 7,641.01. This item has been moved to October 28, 2024, Council Meeting Agenda for consideration.
•Councilwoman Jacobus stated that Chief Ruegg asked her to make a couple of announcements for him with apologies he did not get it to her in time. President Bollendorf asked if any of the items are voting items and Councilwoman Jacobus stated no, they were just informational announcements. She announced the Hatboro PD is taking part in a County wide drug take back event which will be on October 26th from 10-2 at the station and wanted to remind everyone they do not accept needles or liquid medications and Chief Ruegg wanted everyone to know if you cant make the event, the station accepts all unused drugs 24/7/365She also said there will be a Borough Blend on October 25th at Steel Penny from 8-10A.M, there will be intermittent road closures during the Skeleton Skurry on October 26th between 8-11:30 A.M. and asks drivers to use caution when driving in the area of Moreland and Montgomery, and the reason that Chief Ruegg is not here tonight is Sgt. Simon and Officer McMahon are being honored tonight by the Burn Prevention Network and are recipients of the Valley of Courage Spirit awards for their rescue of a resident who was trapped on the second floor of his home that was on fire.

2. Finance/Grants Committee
•UNION LIBRARY EXPENDITURE LIST: Councilman Myers stated included in your packet is the Union Library Expenditure List for the month of September 2024 in the amount of $ 24,378.00. This item has been moved to October 28, 2024, Council Meeting Agenda for approval.
•BUDGET WORKSHOP ANNOUNCEMENT: Councilman Myers stated the Budget Workshop for the 2025 Operating Budget for the Borough will be Wednesday, October 30, 2024, at 6:00 P.M. The public is strongly encouraged to attend.
•PECO GREEN REGION GRANT: Councilman Myers stated included in your packets is information regarding the PECO Green Region Grant. This grant funds up to $10,000 for projects including the following: a. Developing or updating municipal open space plans b. Acquisition of open space through fee or easement c. Habitat improvement within municipal owned open space d. Capital improvements for passive recreation This grant requires a one-to-one match for all projects. If Council would like to apply for this program, we are looking for suggestions for projects. Mayor Schultz indicated that if Council would like to apply for this program, he would assist with writing the grant. Applications are due October 24, 2024. If Council is interested in applying, a resolution will need to be enacted at the October 28, 2024, voting meeting ratifying the application, project information, and match being dedicated. Mayor Schultz suggested LED streetlights and President Bollendorf stated staff will look into it if we can use the grant for streetlights and if not, they will apply for the LED lights for Pennypack.
•FIRE RELIEF FUNDING ANNOUNCEMENT: Councilman Myers stated the Borough is in receipt of the annual Fire Relief Funding in the amount of $56,806.10 and these funds need to be released to Enterprise’s Volunteer Relief organization within 60 days of receipt per law. A check for these funds was cut in September as a part of the approved warrant list and already released to Enterprise. This is an announcement item, and no action is required by Council.
•MMO ANNOUNCEMENT: Councilman Myers stated The Borough is in receipt of the annual state aid for the Borough’s pension plan. These funds need to be deposited into the pension plan by the end of October by law. Included in October’s warrant list will be a check in the amount of $188,746.65 which satisfies this requirement. The remaining part of the Borough’s contribution to the pension plan (minimum municipal obligation funds) will need to be deposited into the pension plan by December 31, 2024. Should you have any questions regarding this funding, please let Manager Hegele know.
•PFM FINANCING: Councilman Myers stated Melissa Hughes from PFM (Public Financial Management Group) gave a presentation at the April 8th Committee Meeting which contained options for financing for various capital projects. PFM has been working with financial institutions on possible financing options. When staff receives this information from PFM, we will provide it to Council for review and consideration.
•LSA GRANT APPLICATION: Councilman Myers stated Included in your packets are the guidelines for an LSA (Local Share Account) Grant. Eligible projects are projects which improve the quality of life in the community. Grants are available for projects with a total eligible project cost of $25,000 or more and shall not exceed $1,000,000 for any project and is a no match grant. Due to the current needs of the Pennypack facility, staff recommend applying for just the gym or Pennypack as a whole for HVAC upgrades. Manager Hegele and Foreman Young have met with different vendors and have as well as our Building Code Official to determine which scope of work will be beneficial. Council will need to decide what HVAC upgrades they would like and approve staff to apply for the grant. This item has been moved to October 28, 2024, Council Meeting Agenda for approval.
•TAX CERTIFICATION COST RESOLUTION: Councilman Myers stated Included in your packet is a memo which states the practice of attorneys and title companies require the local tax collector, as well as tax collectors throughout the Commonwealth, to provide a certification of taxes paid on real estate involved in a sale and that there is no legal requirement for tax collectors to perform this service. The charging of a reasonable fee for this additional service has been a long-standing practice and Tax Collector Mount is requesting council to authorize increasing the amount of tax certifications. Tax Collector Mount would like to increase these fees to $25.00 for a Tax Certification and $5.00 for a duplicate tax bill. She indicated that these fee increases are due to increased time and material costs on her end. It is important to note that the Borough does not receive any of these funds and all funds collected for these services are paid directly to Tax Collector Mount. 3. Community Outreach & Events Committee
•UPCOMING EVENTS – Councilman Hover announced the upcoming October events.
•NEW BUSINESSES: Councilman Hoover stated last year Daddy pops was sold to a new owner and between transitioning to new ownership and the Flasher project they were not ready for a grand opening. On Friday, October 25, 2024, at 3:00 P.M please join Daddy pops for their Grand Opening/1 Year Anniversary Celebration!
•FRIENDS OF CRESSBROOK UPDATE – Councilman Hoover stated the Friends of Cressbrook had to cancel their last meeting but are still accepting memberships and working on their holiday fundraiser which is a new Christmas tree ornament.

4. Public Works Committee
•LIBRARY MAINTENANCE AGREEMENT: Councilwoman Shay stated Last month President Bollendorf asked Vice President Reichner and Councilwoman Shay to review the Library Maintenance Agreement with the Borough which expired on December 31, 2021, and make a recommendation on future in kind services provided to the library. Councilwoman Shay stated that the library receives $ 225,000.00 a year and should be responsible for mowing and plowing and Public Works will continue to hang banners and flags, but they will have to provide a schedule and will still hang the lights on the tree. All members of Council agreed. This item was moved to October 28, 2024, Council Meeting Agenda for consideration.
•SOLID WASTE ORDINANCE AMENDMENT: Councilwoman Shay stated On September 25, 2024, the Public Works Committee held a town hall for business owners and property owners of non-owner-occupied residences to discuss the current refuse ordinance. Council will need to authorize Solicitor Geiser to begin drafting an amendment to the Solid Waste Ordinance. This item has been moved to October 14, 2024, Voting Meeting Agenda for consideration.
•MUNICIBID SALE OF PICK-UP TRUCK: Councilwoman Shay stated Council previously authorized the sale of a 2003 Chevrolet pickup truck to be listed on Municibid. The winning bid was for $ 1, 050.00 and Council will need to approve the sale for said amount. This item was moved to October 14, 2024, Voting Meeting Agenda for consideration.

5. Environmental Affairs & Parks Committee
•EAC UPDATE – Councilwoman Hendrickson stated the EAC did not meet this month, and their next meeting is scheduled for Thursday November 7, 2024.
•SHARED ENERGY MANAGER PROGRAM UPDATE – Councilwoman Hendrickson stated Manager Hegele and Assistant Secretary Derenzis met with representatives from Wilson Engineering in August. They reviewed with staff the fleet study they are working on to assist the Borough with transitioning to an EV fleet where possible. They reviewed with staff upcoming grant opportunities for EV vehicles and EV charging stations. They are currently working on a review of our ordinances to see where EV charger parking resources could work, looking at future development and EV stations. Wilson Engineer is also looking to perform benchmarking of Borough properties as a part of this program.
•PA SOLAR CENTER PREQUALIFICATION SURVEY: Councilwoman Hendrickson stated In September, Council discussed submitting a prequalification survey to the PA Solar Center which will allow the Borough to receive a solar feasibility analysis at no cost. Council did not vote on this item in September, so Council is requesting that Council consider authorizing staff to submit this survey at their October 28th voting meeting.
•LAWN TO MEADOW PROJECT UPDATE: Councilwoman Hendrickson stated Land Studies (contractor for DCNR) visited the project area to make the first application of herbicides in preparation of the new meadow on September 23, 2024. Borough Officials supervised this work and verified that the herbicide treatment dried after application. The grass has died creating a clean slate for the future meadow for the plantings which will take place in the near future. Currently Land Studies is working with the seed supplier to determine what kind of plantings and once we know, we will announce when the mowing and planting will take place.
•PENNYPACK PLAN DISCUSSION/ADOPTION: Councilwoman Hendrickson stated last month residents provided feedback and asked Council to table voting on the Pennypack plan as there was not enough space for a regulation soccer field 2 for 11V11 according to the proposed plan. Council tabled the item in order to get exact measurements from the County and remeasure the field. The County, Borough, and Soccer club have been working to update the plan. A new plan will be presented to Council for review in November with final adoption tentatively scheduled for November 18, 2024. The County is short-staffed and may need this timeline adjusted; however, staff will update Council as any changes arise.
•BIRD TOWN COMMITTEE: Councilwoman Hendrickson stated At the August 19, 2024, Council Meeting, Council authorized the EAC to apply to the PA Bird Town program which would register the Borough of Hatboro as an official Bird Town. One of the requirements is to establish a Bird Town committee and accountability to the municipality either directly or via EAC or other comparable entity. Council will need to authorize the EAC to establish a committee for the Bird Town program. This item has been moved to October 28, 2024, Council Meeting Agenda for approval.
•ADA PLAYGROUND UPDATE: Councilwoman Hendrickson stated in 2021, the Borough of Hatboro received a grant for an ADA playground to be installed in Memorial Park. The Borough has been waiting for HUD to release funding for the project. In preparation of funding being released, the Borough will begin meeting with vendors to obtain quotes for the future playground. We are hoping to have the playground begin construction in 2025 with a grand opening later next year. We will continue to provide updates on the project as time continues.
•MILLER MEADOW GRANT UPDATE: Councilwoman Hendrickson stated Manager Hegele and Engineer MacNair recently met with DCNR to discuss the Miller Meadow Phase 2 project. This project has been in development for a few years; however, the grant expires December 31, 2024. DCNR stated that the Borough would need to fully complete the project by December 31st or could request a one-time one-year extension to complete construction. Unfortunately, it is not realistic for the project to be bid and fully constructed by December 31, 2025, due to constraints due to weather, plan preparation, etc. As a result, DCNR recommended that the Borough of Hatboro return the grant and apply in the future. DCNR stated that since the project is shovel ready with minor adjustments, the project will be favorable for future grant funding. Staff is asking Council to authorize the return of this grant so staff can provide DCNR with an official letter. This item will be listed on the voting meeting portion of the agenda for consideration. This item has been moved to October 14, 2024, Voting Meeting Agenda for approval.
•NATALIE FORBES GARDEN DISCUSSION: Councilwoman Hendrickson stated The EAC had requested to place an honorary pollinator garden for Natalie Forbes at Loller Academy and last month Council discussed that they did not think Loller Academy was an appropriate placement due to the amount of public that use Borough Hall and as you know, tragically we lost an employee who died from a bee sting. After some discussion, an appropriate placement was not decided on and this item was tabled to this month. Council will need to discuss and decide on an appropriate placement for the honorary pollinator garden. Kelly A’Harrah asked if Council could table this item until the EAC can discuss and suggest a location that will be appropriate.
•2025 POOL SNACK STAND RFP: Councilwoman Hendrickson stated Included in your packet is a copy of the Hatboro Memorial Pool Snack Stand RFP (Request for Proposals) for 2025. Typically, staff will ask Council to approve the RFP in the Spring; however, it has become increasingly more difficult for the Borough to find a vendor for the snack stand. In the past few summers, Borough has had multiple issues with Borough’s current vendor. As a result, the Pool Committee would like to release this RFP 3 sooner than later in attempt to attract more interested parties for the 2025 season. This item was moved to October 14, 2024, Voting Meeting Agenda.

6. Administration Committee
•MEETING ANNOUNCEMENTS – Councilwoman Reichner announced the upcoming meetings.
•VOLUNTEER ANNOUNCEMENTS- Councilwoman Reichner stated we have a few open volunteer positions and are currently accepting letters of interest/applications for: • EAC Chair • EAC Member • Parking Commission Member and anyone interested to send a letter of interest to the Borough Manager.
•LAND DEVELOPMENT UPDATE – Councilwoman Reichner stated the Land Development Updates are as follows:
– CVS Property: Development Continues and construction of the building will begin shortly. 21-23 & 37 N. York Road (Canalley Property): The applicant is currently working with PenDOt, and we will keep everyone updated when the developer applies for and is issued his demo permits.
– Victorian Village: New construction of building D continues and is moving pretty quickly!
-100 Meadowbrook: The applicants’ permit is currently under review with our Building Code Official.
– 104 W. Lehman Avenue: All plans were recorded with the County and therefore the property is officially subdivided and was resold. We will keep everyone posted if and when we receive application for new construction on the empty lot.
– 2-4 Home Road: The applicant for the 2-4 Home Road Project is working on finalizing the financial security agreement for this development and confirmation from RVE that it is OK to move forward.
– 410 N. York Road: The applicant is still working with their planner to make amendments to their land development application and is currently waiting for a response from PennDOT regarding the driveway. Gamburg’s: We will continue to keep everyone updated regarding the sale and proposed use of the property when the time comes.
•ZONING REWRITE UPDATE: Councilwoman Reichner stated The County presented the zoning rewrite to the Planning Commission members on June 11, 2024, Planning Commission meeting and the PC met on September 10, 2024, to discuss procedures and policies on how they would like the County to present the rewrite. They met on October 8th to discuss the proposed zone changes for R1 and will meet next month to continue the discussion. The public is strongly encouraged to attend these meetings and anyone who is not able to attend can get updates from the website that was created on myhatboro.org also any feedback can be emailed to Manager Hegele at dhegele@myhatboro.org, and she will present to the PC at the meeting during the Public Comment section on the agenda.
•HISTORIC COMMISSION ORDINANCE UPDATE – Councilwoman Reichner stated in recent months, the Historic Commission has had difficulty achieving a quorum and has not been able to meet. The Historian, Bill Tompkins, has requested that Council consider an amendment to the Historic Commission Ordinance that would make the Historian (who is not currently a member of the Commission itself) an alternate on the Commission. This would allow the Historian to serve as a member of the Historic Commission and count towards achieving a quorum in the event other members cannot attend. If Council is interested in pursuing this ordinance amendment, staff will place this item on a future voting meeting agenda for consideration.
•AMUSEMENT DEVICE ORDINANCE UPDATE – Councilwoman Reichner stated The Borough’s current Solicitation Ordinance is extremely outdated and needs updating in order to address modern amusement or “mechanical devices” that did not exist in the 1980s when the current ordinance was adopted. Staff is asking Council to consider an amendment to this ordinance that will allow easier enforcement of various mechanical devices and associated registrations/fees. If Council is interested in pursuing this ordinance amendment, staff will place this item on a future voting meeting agenda for consideration.
•AMERICA 250 RESOLUTION – Councilwoman Reichner stated AMERICA 250 RESOLUTION: Included in your packet is a sample resolution supporting the America 250 PA initiative. This initiative was created by Pennsylvania legislature and the Governor in 2018 to plan, encourage, develop, and coordinate the commemoration of the 250th anniversary of the United States and Pennsylvania’s integral role in our nation’s past. In accordance with this celebration, the America 250 PA organization is requesting municipalities across all 67 counties to enact a resolution supporting this program and its goals: Educate, Preserve, Innovate, and Celebrate. If Council is interested in supporting this initiative, staff will prepare a resolution for Council to enact at the October 28, 2024, voting meeting.
•RATIFICATION OF 246 E. COUNTY LINE ROAD ASSESSMENT APPEAL- Councilwoman Reichner stated Last month a memo from Solicitor Geiser regarding an assessment appeal filed by Hatboro-Horsham School District stated that her office had been contacted by the attorney representing the School District to propose a settlement of this pending appeal for the abovementioned property. The memorandum provided Borough Council with a summary of the pertinent information to evaluate and vote on a course of action. The property at issue is situated on 2.49 acres, is identified as Parcel #08-00- 00963-00-1 with address of 246 E. County Line Road, Hatboro Borough, and is owned by W H Bentz SR Properties LP (“the Taxpayer”). This property is improved with an industrial warehouse and manufacturing facility. The reassessment of this parcel results in money owed to the taxing agencies, including the Borough in the amount of $ 6,317.86 for Borough taxes and Council will need to ratify the approval of the stipulation. This item has been moved to October 14, 2024, Voting Meeting Agenda for approval.
•DISTRICT COURT RFP – Councilwoman Reichner stated Included in your packet is a copy of the Request for Proposals for the sale of the District Court Property, 420 S. York Road. As you are aware, the Borough of Hatboro owns a condo within Victorian Village that previously housed the offices for Montgomery County District Court. In late 2023/early 2024, Montgomery County consolidated their District Court offices and no longer has an office in Hatboro. The Borough of Hatboro does not have a use for this condo unit and has been incurring expenses for condo fees and utilities even following the departure of District Court. As such, the Borough would like to sell this property. Solicitor Geiser prepared a request for proposals that are required for the sale of the property. Council will need to approve this request for proposals during the voting portion of the meeting. Once this RFP is approved, staff and Solicitor Geiser will work on advertising in preparation for the sale. This item has been moved to October 14, 2024, Voting Meeting Agenda for approval.
•MONTCO 2050 RESOLUTION – Councilwoman Reichner stated Montgomery County recently announced their newest comprehensive plan: Montco 2050. In accordance with the development of this plan, Montgomery County is beginning outreach to engage the public, municipalities, and other stakeholders. This outreach is currently being performed as a survey which polls participants on important topics including housing, open space, road infrastructure, transit, land development, public health, community, economic development, sustainability, the environment, and more. To participate in the survey, please visit Montgomery County’s “Engage Montco” site (also linked on the Borough’s website). The feedback and information provided within these surveys will become an integral part of developing the future Montgomery County.
•LANZETTA LITIGATION – Solicitor Geiser stated on the voting agenda tonight Manager Hegele and President Bollendorf have been personally sued by their official capacity by Mr. and Mrs. Lanzetta for property located in the Borough and the litigation is a challenge of the trash fees and as such Manager Hegele and President Bollendorf were named instead of the Borough so Council will need to vote to authorize her to represent them. This item was moved to October 14, 2024, voting meeting agenda for consideration.

OLD BUSINESS AND UPDATES – There was no old business or updates.

PUBLIC COMMENT – Kelly A’Harrah, 145 W. Lehman Avenue, stated she understands how difficult it is to work with agendas and get everything in, but it was her understanding that if you want to add to the agenda you need to vote on it. She also stated that she realized the announcements were time sensitive from the Police and appreciated them but would like the same protocol for all boards and commissions including Council. Councilwoman Jacobus stated Chief Ruegg apologized for not meeting the deadline but made sure it was nothing that required a vote and it was just announcements, and she apologized. Solicitor Geiser stated that they were only announcements, and a vote is not required to make announcements therefore procedurally, she does not have an issue legally with Councilwoman Jacobus making announcements for the Chief.

VOTING MEETING AGENDA

CALL TO ORDER – President Bollendorf called the October 14, 2024, Voting Meeting to order at 7:43 P.M.

PUBLIC COMMENT – (VOTING ITEMS ONLY) – Kelly A’Harrah, 145 W. Lehman Avenue, stated that she supports restarting the Miller Meadow grant.

Donna Lanzetta, 127 S. York Road, stated that business with the lawsuit could have been avoided if she had been able to meet with Manager Hegele in person and thinks it is ridiculous and it could be avoided.
Carmen Lanzetta, 127 S. York Road, stated he wants to know how the situation will be rectified and is at the meeting because he has no other outlet and wanted to discuss the litigation. Solicitor Geiser stated that she suggests that he doesn’t talk about it and advised Council not to delve into the case either as anything said could be held against in court. Mr. Lanzetta asked if they were going to explain why this was going on and why he is suing President Bollendorf personally because Manager Hegele doesn’t do her job because he kept trying to get in touch with her to discuss it and received no response from her.

RATIFICATION 246 E. COUNTY LINE ROAD ASSESSMENT APPEAL STIPULATION – Councilwoman Shay made a motion to ratify the approval of the 246 E. County Line Road Assessment Appeal Stipulation. Motion was seconded by Vice President Reichner, all ayes. Motion carried 7-0.

SOLID WASTE ORDINANCE AMENDMENT – Councilman Myers made a motion to authorize the solicitor to begin drafting an amendment to the solid waste ordinance. Motion was seconded by Councilwoman Jacobus, all ayes. Motion carried 7-0.

SNACK STAND RFP – Vice President Reichner made a motion to approve the request for proposals for the Hatboro Memorial Pool Snack Stand. Motion was seconded by Councilwoman Hendrickson, all ayes. Motion carried 7-0.

DISTRICT COURT RFP – Councilman Hoover made a motion to approve the request for proposals for the sale of the District Court property and to authorize Solicitor Geiser and Manager Hegele to proceed with advertising the RFP. Motion was seconded by Councilwoman Hendrickson, all ayes. Motion carried 7-0.

MUNICIBID SALE OF PICKUP TRUCK – Councilwoman Reichner made a motion to authorize the sale of a 2003 Chevrolet Pickup truck to the winning bidder on Municibid in the amount of $ 1,050.00. Motion was seconded by Councilman Hoover, all ayes. Motion carried 7-0.

MILLER MEADOW GRANT – Councilwoman Jacobus made a motion to authorize the return of the DCNR funding for the Miller Meadow Phase 2 Project and to authorize staff to do the same. Motion was seconded by Councilman Myers, all ayes. Motion carried 7-0.

AERODROME LITIGATION – Councilwoman Jacobus made a motion to authorize the Solicitor to represent President Bollendorf and Manager Hegele in the Lanzetta legal matter and to authorize the Solicitor to take possible counter action including but not limited to payment for reasonable attorneys’ fees. Motion was seconded by Councilwoman Shay. President Bollendorf abstained. Motion carried 6-0 with 1 abstention.

OLD BUSINESS AND UPDATES – There was no new business or updates.

NEW BUSINESS – There was no new business.

PUBLIC COMMENT – Tom Gormley, 519 Continental Road, stated that he doesn’t think that the Borough should be in the trash business.

John Weinrich, 52 Byberry Road, asked when the vote will be to pass the ordinance and President Bollendorf stated possibly November, so it would be discussed at the Committee meeting and voted on at the council meeting and has to be done as tax bills are ratified in December.

Donna Lanzetta, 127 S. York Road, stated that she was told by other business owners that if there was an issue, their tax bill was changed. Manager Hegele stated that the Tax Collector cannot change the bill once she prints them, and Mrs. Lanzetta stated that it was not true.

Carmen Lanzetta, 127 S. York Road, stated he was told to submit a letter in writing to get private collection and the bill would be prorated accordingly, and he did everything he was told, and his bill was not changed and was told by Tax Collector Mount she knew nothing about the situation, and he reached out to Manger Hegele and got no response. He stated he was told he had to wait until next year and he knows that is a lie because the Braccia’s were being charged for the restaurant but they had a dumpster and within a week she received a new tax bill and the trash charge was removed and feels there is no consistency and it is irresponsible.

ADJOURNMENT – Councilwoman Jacobus made a motion to adjourn the October 14, 2024, Voting meeting. Motion was seconded by Councilwoman Shay, all ayes. Motion carried 7-0. President Bollendorf adjourned the October 14, 2024, Voting Meeting at 8:00 P.M.
